Ripoff cashed check & will not send product New York

I ordered a phone case from Cellularking.com. Within 10 days he cashed my check, I have proof, (I have a copy of the cashed check.) I have called him several times and he puts me on hold and or tells me to call back. I have my phone record to proof this also. I have called and talked to Kenny at least 10 times.

I even faxed him a copy of the cashed check front and back and he still says he needs proof that this is his account that cashed the check.
