JOSH BENETT contracted me on May 9th as his graphic designer/creative director under a formal and well documented freelance agreement of monthly payments. I committed over 150 hours of creative services to his company and was never compensated. The first check was "lost in the mail" and never arrived, after almost 30 days past-due he issued a promise to resolve this situation himself by any means possible, even repeatedly offering to fly to my location to take care of this delinquency personally.
Despite this bold assurance and MULTIPLE broken promises, this debt lapsed to over 60 days past-due without resolution and now in total includes two monthly payments past due. He has given me every excuse in the book, some I read before in his other negative postings featured on this site. It was not until I informed him of my intent to involve my legal team to complete what he would not, that he agreed to overnight me the compensation due (multiple times). As his 5th and last deadline past before I began formal litigation proceedings, he finally provides me with a tracking number for a package he acknowledged only included half of the compensation due. The tracking number was invalid, of course, and no package ever arrived. Mr. Benett understood quite clearly the consequences of his many delays, excuses and broken assurances, this was his last chance to make restitution for his gross mis-management of my compensation due and this report is only the first stage of my intended legal actions.
Given what I've recently learned about his past irresponsibility dealing with investors, vendors, designers and employee's from all over the country - all of which have yet to confirm the resolutions he is so quick to claim in his rebuttals - I will be officially summoning Mr. Benett to District court to seek judgment against him for his neglegence and continued prevelence for non-payment. Mr. Benett has, and continues to use my intellectual property in national magazine publications and on the web despite never compensating me for them. This is fraudulent, unethical, unprofessional and is theft. I will pursue him and Resolute Entertainment, Inc. To the fullest extent of the law.including but not limited to the submission of this account and evidence of his history of fraud to the district attorney for prosecution.
Mr. Benett has completely compromised the finacial integrity of my creative proprietorship and I will not rest until I recieve full restitution and possible punitive damages for his gross neglegence and inaction concerning the compensation owed, and remaining rather embarrassingly past due. Should Mr. Benett be so bold as to dispute or submit a rebuttal to my claim, I will post his official electronic correspondences apologizing and acknowledging the expressed above multiple times without, of course, any tangible action to resolve what he knows he should. Please be informed, Mr. Benett, that NOTHING IS RESOLVED until I have confirmed it as so, and will be updating this report accordingly with any pertinant information concerning this delinquency.
If Mr. Benett or any representative from Resolute Entertainment, Inc., Dolce Capital, Inc., or JB Entertainment, Inc. Solicit you for your services, be warned of his well documented history of non-payment and fraud. Do so at your own-risk and be prepared for the most frustrating experience of your life.
