AUP - Acceptable Use Policy, Appeals AUP violation (?) Froze my account and held my funds for 2 years, refused to consider an appeal

I understand and fully support Acceptable Use Policies of companies like Paypal. But my story seems ridiculous and I suspect there are others.

Someone posted a donate link to my paypal account on their (unacceptable) web site, asking others to donate to my account to help pay for hosting his service on my servers. Repeat, SOMEONE ELSE posted a paypal donate link for my account on SOMEONE ELSE's server.

I know this guy and when I found out, I was furious at him. He did not have permission to post my paypal information anywhere, much less on his adultish site. But that's beside the point.

How can my conformance to an acceptable use policy be violated by the actions of SOMEONE ELSE on a web site that is NOT MINE?

They told me I could file an appeal in the Resolution Center. When I went to the resolution center online, there was no way to file an appeal. I had to hunt down their appeal email address by googling for it.

I tried to appeal this decision several times, and was refused. I was told either a) i could not appeal in this case or b) they reviewed the case and confirmed the decision to cancel my account.

They wouldn't let me open a new id using the same underlying bank account.

They sent me email telling me I should login and withdraw my funds. When I logged in, my account was restricted and I couldn't do anything.

They kept notifying me that they had the right to hold my funds for 180 days. Fine. After 180 days, I still couldn't do anything in my account, much less request a withdrawal of funds.

At one time, because of the convenience and good interest rate, I had more than $10,000 in my account. Thank goodness this was not the case when they froze my account.

I have finally received my funds. This is not the point.

They held my money hostage for 2 years because of something someone else did. So let me get this straight... If I don't like someone, I just make an adult site and put a donate link on the site to that person's account? Hmmm... Anyone else see a problem with this?

If this has happened to others, I see a decent class action lawsuit here.

Love
