Pacific Webworks - EAuctions Scam & Ripoff

On March 6 I purchased a free trial of E-Auction success, it was a 14 day free trial, at only $1.95. On March 7 I called 1-800-497-4988 (the toll free number) to cancel my trail because what I paid for was just a bunch of links to random sites which I had to pay for as well, a whole load of crap. They gave me a reference number, which I kept for a couple weeks, then threw it away thinking this whole thing was all over.

On March 28 I used my debit card (linked to my checking account) for some purchases, one was for Notre Dame tickets and another was to pay my credit card bill online (like I do every month).

Now, I run my debit card as credit because I have a "sign and save account" where whenever I run it as credit they put the spare change into a savings account. So these item's take a couple of days to clear. Now my bank account was running a little low at this time, but I had the money to post those two items to my account.

On March 30 EAUCTIONS put a hold on my account for $59.90. Of course that was on a Sunday so I had to wait until Monday to contact someone. I was furious.

On March 31 EAUCTIONS posted to my account and deducted $59.90 from my account. My 2 previous items had still not posted.

Monday March 31 I called the 1-800 number to ask why they charged me. They said I never canceled! I told them that was total bull and they asked me for my reference number and I said I didn't have it anymore because I had canceled nearly a month ago! So after being transferred to numerous people I finally got a halfway friendly lady. She told me to fax them my phone bill showing them where the call was at on the phone bill & they would refund that money.

So I faxed them the phone bill the next day circling the call to their number. They claim to be refunding that money to my account, but apparantly it takes 7-10 days (I've yet to see the refund in my account).

But anyways, on April 1 the $16 posted to my account, thus overdrawing my account (b/c I was not expecting $59.90 to be withdrawn). I have overdraft protection so my bank paid it, at a fee of $25. So that $16, cost me $41.

Also, my credit card payment which was suppose to be deducted from my account tried going through, and did not go through. Which incurred fees from my credit card company, and my bank.

I called EAUCTIONS and they claim it's not their fault that I have all these fees! When it IS there fault b/c if they wouldn't have WRONGLY charged me I wouldn't be out of all this cash! So far the fees alone are totaling in the ballpark of $139!

A supervisor is suppose to call me back Monday April 7 in regards to this, but they say they aren't going to pay me that $139.

I'm prepared to take them to small claims court over this. So any attorneys out there, or anyone who knows how to draft a demand letter, please respond to this post.
