Made order and paid, but order never arived and company refuses to give refund like promised Ripoff Simmern

On the 21st of April I made an order for a total of 122,42EUR from www.iced-out.Biz. I ordered a watch, a belt, and a necklace. On the website it clearly states that international orders should take 2 weeks maximum. Now, nearly 4 months later, I still haven't received my order.

I have had contact with them numerous times through [email protected], but every time they replied with excuses saying they were still tracking my order.

Below are the E-mails in order by date:

Good day,
More then 2 weeks ago, on 21 April, I made an order by bank deposit from South Africa for 122,42EUR, but I still haven't received my order.
Is there a problem?

Almost 5 weeks ago, on 21 April, I made an order by bank deposit from South Africa for 122,42EUR. When it still hadn't arrived after the first 2 weeks, I sent you a
mail asking you if there was any problems and you told me you would ship it in 2 days time. That is now nearly 3 weeks ago and I still haven't received my order.
According to your website it should take no longer then 2-14 days for the package to arrive. Is there a problem again?

I'm trying to keep my patience, but it's now been exactly 2 months since I made my order and I'm getting frustrated.
I know it shouldn't take an entire week to simply track an order.
Your website states that you are responsible for the goods until they arrive. If the order is lost, which I fear is the case, I expect you to send the goods again or give a refund.

Please reply as soon as possible.

I'm still waiting for a reply to my last E-mail.
Don't tell me you simply stop replying when a customer doesn't receive his/her order. That's no way to conduct business.

*On that same day, my legal attorney decided to sent an E-mail as well*

Dear,

Laszlo has tried now for a while to get a response regarding the items he ordered from your website. Since weeks though he does not receive any answer and does not know the status of his order.

I am his legal representative and on his behalf I request you friendly to please ensure he receive a repayment for the items that were not delivered as should.

It may be hard to sent items to South Africa. But if your company can not handle a reliable shipment or you are not able to track the items once they leave your country, which is most likely the case, you should not deal with people having a delivery address outside Europe.

To keep relations friendly (internet is a powerfull medium and a companies credibility can easily be destroyed) I would appreciate if you sent Laszlo the requested repayment as soon as possible. Our bank details are;

*More then 2 weeks after that E-mail, and now more then 10 weeks after ordering my package, another one of my legal representative's sent them a fully explanational E-mail*

Good day,

This is Laszlo's legal representative, Shane W. Seymore.
Laszlo made an order from your website, www.iced-out.Biz, on 21 April, for a total sum of 122,42EUR.

Now, the 13th of July, more then 10 weeks later, he still hasn't received his order.
Every time he E-mails your company asking about his order, you simply state that you have sent his order already, or are busy tracking it, but after a few more days of waiting after that, the order still never arrives.

Last time Mrs. Schuman sent an E-mail in which she kindly asked for a refund, to which you replied that you had shipped the order to South Africa and told us to wait for a few days. Quite frankly, more then a few days have passed, and the order still hasn't arrived.

As Mrs. Schuman stated, It may be hard to sent items to South Africa, but if your company cannot handle a reliable shipment or you are not able to track the items once they leave your country, which is most likely the case, you should not deal with delivery addresses outside Europe.

Laszlo has been very patient with you this far and has waited for over 10 weeks for the order to arrive as I stated earlier. However, if no noticeable action is taken from your side soon, we will be forced to take measures.

Internet is a strong tool and can be easily used to severely damage a business' credibility. Websites such as usacomplaints.com offer a service that allows victims of scams to publish their story for a few million visitors to read every month and further websites against a business can be created for merely $10 per website.

We do not wish to take such drastic actions, and I am sure that you do not wish for us to take such actions either. However, if needed, we will do it.

We urge you to send the requested refund of 122,42EUR immediately.

*So, now we had made everything clear, had threatened to publish a case against them, and they had once again promised to track the order. However, 3 days later. Still nothing.*

July 16:
We are now tired of waiting. You have until Friday evening to send the requested refund of 122,42EUR. If after that, no payment is received, we will start posting rip off reports on internet regarding your company. The way you are treating Laszlo as a customer is unacceptable.

This is your last reminder and final warning.
If tommorow evening, The 19th July, Laszlo has not yet received the requested refund of 122,42EUR, we will start posting rip off reports on internet regarding your company. Once again, the way you are treating Laszlo as a customer is unacceptable and will not be tolerated. We will not hesitate to spend the necessary days posting negative advertisements on internet regarding your company.

*So once again, they claimed they were tracking the package. This time I decided to wait a bit longer and give them some time. Later on, to my surprise, they checked up with Seymore, my legal representative themselves*

No, I still have not received the items.
May I ask, what are you planning on doing to repair this damage?

*This last reply has now been 5 days ago and I still haven't heard anything back from them. As I said, it has now been nearly 4 months and I still haven't received my order, which they assured me would take 2 weeks maximum to arrive. I have been very patient with them, and even posted this rip off report 2 weeks later then I said I would. Once this report is posted, I will send them yet another E-mail notifying them that a complaint has been posted against their business and to do something to set it straight. I understand shipping products to South Africa from Germany may be difficult, but if they can't do it, then they shouldn't claim they can. I want either a full refund back or my ordered products in my hands before I shall stop trying to discredit their company and cause them to lose as many customers as I possible can. Trusting customers do not deserve to be treated this way.*
