Ripoff fraud unjust enrichment

My sister got me a DVD Season set for Christmas in early November. Since most people don't open gifts until December 25th (over a month later), I didn't know until over a month later that one of the DVD disc holders was completely smashed. I didn't want one disc getting damaged so I wanted an exchange. This company's normal policy is one month but after I came back to CT from NC, I e-mailed the company. I was told via e-mail (the only way to communicate with them since the phone # doesn't work & it's only on-line) that since the item was a Christmas gift, I could exchange the item if I returned the defective set & the invoice.

Not being a moron, I made a copy of the invoice & am 80% sure I enclosed a copy as well as my defective DVD set. Further, I put delivery confirmation on my package & have that slip in my possession.

The item was mailed on January 5 and the delivery report said it was delivered in Fontana, CA on January 10th. I then received no word about this exchange. After a series of e-mails to "Mike" as well as sending a copy of the invoice & getting nowhere, I filed a report with the Better Business Bureau. I've pointed out numerous times that this is fraud and they can not keep the DVD set & not give a refund; they must do one or the other.instead, they've done nothing. My mother is working on sending them a Post Office report verifying that they received this package since they are denying they did this order though I have evidence—my sister has washed her hands of this ordeal.

It is not normal business practice to take single packages from out of state with unknown senders, keep the same packages and not contact a person. I also asked for shipping since I had to pay over $4 of my money for my own gift being defective when THEY caused it. They have the highest shipping rate of any e-retailer I've seen or done business with. I also sent e-mail telling them when I sent the package & what I was doing as well as the full invoice so they knew what was going on.

I would like to see this company shut down permanently but for now, I intend to contact all consumer advocacy groups and media that I can with my busy schedule as a full time law student.
