On 2/18 I went into Advance Colonics located at 15982 Quantico Rd, Suite E, Apple Valley, CA 92307. At that time I purchased a package of colonics treatments for $194.20. Bernice stated that the credit card machine was not working so she took an imprint of my credit card and had me sign a credit slip. She said she would run it on that Wednesday Feb. 20. I went back that Friday Feb 22 and got a body wrap. Bernice stated that the credit card machine was still not working.
All I had on me was my credit card so she took another imprint and had me sign a credit slip for $103. She told me I had to meet her the next day on Saturday to give her the cash in exchange for the credit card slips becasue she was going to get in trouble. On Saturday Feb. 23 Bernice called my house three times at 12:54PM, 1:15PM. And 2:04PM. She spoke with my son and told him it was urgent. When my son gave me the messages I headed over to the ATM machine on Main st and withdrew $300 at 4:13 PM.
On Sunday February 24 at 11am I called Bernice to let her know that I had the cash and apologized for not being available that Saturday. I asked her if I could give her the money on Monday at the office but she insisted that she needed the money beofre Monday because she would get in trouble. I asked if I could meet her after I got out of church but she said she couldn't because she was having breakfast with people from her church and was going down the hill. She told me to meet her at Molly Brown's Country Cafe on Hesperia Rd. I was there at 11:20AM and called her. She came out to the parking lot. I gave her the $300 in cash and my 2 boys witnessed that since they were on the back seat of my car. She gave me the 2 credit slips back as proof that I had given her the cash. I told her that next time I went in the office I would like a cash receipt. She said that since I was getting the credit slips back there was no way my credit card could be charged. I left and thought nothing of it.
On March 10 there was a charge of $297.30 on my bank account from Advance Colonics. I was totally confused and as a result of that I was charged $140 in NSF fees. I called Bernice to inquire about it. At first she said she did not know how that happened since she had given me the credit slips back. She said it happened because I did not give her the money on Saturday and by the time I gave her the money on Sunday the card was probably run through then. She said it was an error and that she would be crediting my card and that I would get my money back. The next day she said that she had called her credit card company and had given me a credit of $298. She said it would take 24 to 48 hours to post onto the account.
On Friday March 14 I made an appointment to get one of the colonics that I had purchased and to get my son a footbath. While I was there Bernice avoided me so I asked the two other women in the office, Maria and Gloria, about my cash receipt. They said they knew nothing about it. When I explained what had happened, they told me that I had to talk to Bernice about it. She had me wait for more thyan an hour. I told her I had to leave by 5:30pm to pick up my son but I made alternative arrangements and waited for her.
When she finally decided to talk to me she took me into a room and closed the door. She did not like the fact that I had mentioned the situation to Maria and Gloria because she said that was her problem. I asked for a cash receipt for the $300 I had given her on Feb. 24 and she said she could not give me one because it would mess up her books. I told her I had no proof that she I had given her the $300 cash. She told me she had already issued a credit for $298. I told her that I still needed something in writing that I gave her the cash. She left the room and came back with a small notepad of yellow lined paper, whe she wrote that on Feb 23 she had received $298 dollars from Laura Bautista. I told her that the whole situation was very unprofessional and she got upset saying that if I had given her the money on Sat. The 23rd this wouldn't have happened but it was my fault for waiting until Sunday the 24th to give her the money.
On March 18 I called my bank to see if I had gotten the credit. I spoke with Manita and she called Bernice to ask her about it. Bernice told her that I had never given her any cash and that the charge was real since she had the original credit slips which she faxed to my credit union. I was advised to file a police report which I did that same day. The police officer called Bernice and once again she denied getting any cash from me. I tried calling her after that but Maria said that Bernice was busy.
Today March 19 I called at 4:52PM and spoke with Bernice. She told me she wouldnt give me my money back and would not talk to me because she got a call from my bank and the police accusing her of fraud and that I had to deal with her attorney. Then she hung up on me.
