Sprint Makes Promises, Gives false information

Janurary I decided to get a sprint phone, I got my phone from a local sprint store and paid over 600 bucks for it (was never informed it would be 100 with a contract.) The phone was the new HTC Evo 3d phone.

I signed a contract and was one the unlimited 69.99 plan plus fees and insurance minus 10% for my credit union discount, I was told I had 14 days to cancel etf free and I agreed.

The first 14 days were spectacular, no issues, about a month after actiating my phone I started having MAJOR issues, I could not make calls, Dropped calls, Had virtually no internet access, and this is at my home where I should get Great service, this was before they switched nextel to the sprint towers (they did this in... May or june this year)

My buddy across the street from me had nextel for 7 years, and his phone had no issues! (untill later)

I contacted sprint SEVERAL times, they continued to inform my it was my brand new phone, it wasn't.

Nextel phones worked in other cities such as athens, my sprint phone, NOTHING.

2 months in, it got worse, and I refused to pay the bill, I then found out from another friend that he had the SAME issues with his HTC phone, they told him it was his device, he swapped it out four times with the same issues, they suggested he get a new phone so he paid for their iPhone, which surprise had the same issues!

But when he called on the issues with the iPhone he was told "It was never your device, we are experience tower issues that have not been fixed yet"

Boom! Tower issues (this was the same time I was having my issues!) Theyy gave him 20 bucks a month off his service for the issues (wow can;t use your service and it is only worth 20 bucks)

I called sprint and asked them about it and was told I was wrong, they have no issues, I looked at his bill, he has the credit, he called with his ticket number on speaker phone and behold, they did have unresolved tower issues!

At this point I informed them I believe they broke the contract and to cancel my service.

Now they want to charge me 350 bucks for service 300 bucks for an ETF AND they are holding my phone hostage which i paid RETAIL for, no service discount price, but retail. And they refuse to let me do with it as I please (my phone)

They also refuse to squash the bill, they broke the contract by not offering service provided, actually I had dang near NO service.

After I canceled i went to metroPCS for 50 bucks a month with the HTC wildfire and guess what, NO ISSUES, no dropped calls, can make calls internet works great, I took my family to Michigan adventures in july and my phone worked the whole way there! Great gps, had full bars the entire time there and back. A no contract prepaid phone works better then a contract phone, GO FIGURE!

I have considered my options, and with all the evidence I have I plan on sueing Sprint.

On the same note that buddy with nextel of 7 years, when sprint shut the nextel towers down and made boost/nextel use them in may i believe it was. Or june his nextel phone went straight to junk, Just like my sprint phone couldnt make calls and dropped incoming calls and he had a nonsmart flip phone, he immediately canceled his service (they waived his etf fee as he just got a new contract, because wow, tower issues and was not his fault!) he has since gone with metro aswell and is completely happy!
