CashforLaptops.com Bait and Switch, Fast Talking, Can't Scam Me

On 11/9 I checked websites to sell an iPad (v1) 16gig wifi model. It was in the box, with the factory sticker on the screen. It had been used less than 1 hour. Gazelle offered $255, but CashforiPads offered $285, so I took the offer for higher money.

They sent a box to ship it back in. It was a badly beat up box with no packing material, so I packed the iPad in its manufacturer box, and all cables. They promised if you sent it within 2 business days of receiving the packaging, you would receive a free gift so I did that. I received the packaging on 11/16 and sent it via UPS 11/18.

They received it 11/29 according to their email and signed for by JOHN (according to UPS).

They inspected it and claimed I would receive a phone call within 5 business days. I gave them my work number. I work at a financial insitution and all calls are recorded and noted - THEY DID NOT CALL. I gave them a cell number. They never called. So finally, on 12/7 I called them.

I spoke to BRIAN - who is also mentioned on another complaint. BRIAN told me that the device had pitted marked, scratches etc and was only worth $120 and they can have the money to me tomorrow morning. I explained that it was not pitted, it had a factory sticker on it from the screen, had never even been synced. He told me that their company is "good for the environment" and the "scratches" make the gorilla glass hard to render. (?). I work in IT, and handle the iDevices for our FI. I told them that was a load. I told them I wanted the $285 they offered, or I wanted my device back as fast as they got it FROM me and I would sell it on eBay.

He told me that they wanted my device and to come up with a mutually agreeable number. I told him there was no mutually agreeable number aside from the quote given to me when I filled out the form on the website. He told me that it would take 3-4 weeks to return the item. I reminded him that the FTC does not allow that - that the law is that if an item has to be returned, he has 7 days and it has to be returned in the same manner OR BETTER than the way it was sent to me. After a few more minutes of arguing - BRIAN got quiet, spoke very softly and low, and told me $285 would be sent to my paypal account in the morning.

I had such a bad feeling I called back and talked to Wendy, who transferred me to Ben who confirmed that $285 would be coming to me, although "it could take a few days for Paypal to clear it". I told him that Paypal was instant, I have a premier business account so I wanted to know when it would go through. He told me tomorrow. I told him I wanted to file a complaint so he forwarded me to some voicemail where Darren McCarthy -purcashing manager - said he was "looking forward to hearing my feedback" and to "not worry, he wouldn't bother me by calling me back". I said in the message I'd love a call back.

I doubt I'll get one, but I am making it my daily goal to post this story to all forums so nobody else will use this company. Underhanded bait and switch. Luckily I know the law and how it works and they couldn't talk circles around me.
