I need help with getting my money back from this company. Please any legal company help me and other people who fell victim to this fraudulent company. Work needs to get out immediately about this company located in Texas. It sounds like another ENRON company looking to take people's hard earned money for no merchandise.
Please see my letter to the company below:

I, Roseanne, am requesting a full refund of the Help Me To Buy program. I signed up November and signed up for bi-weekly payments. My account number ID #: 215509. I was told by a male customer service agent that I was unable to receive a full refund of the money I paid into my computer package at the beginning of February and to continue to pay for my computer bundle anyway. I put more than $998.82 towards a computer package that also had not been sent to me after paying 13 weeks into the program. I stopped making payments in February because I requested to change my mind and receive my refund, instead I was told I would not receive it and that your company does not issue refunds of payments made. There are two reasons why I stopped paying, one is because I paid on-time, received no shipment and decided to change my mind and it was also like I was paying your company for nothing. I paid almost $1287 into the program and now I am requesting a full refund of the payments I have made since 2006 and because I changed my mind on the program in 2008. Therefore, I was refused a request for a full refund of the money I paid into the program the first time because your company did not offer a refund and the second time your company said I was in default since February.
I have tried to contact your company at the three different phone numbers. 1-800-992-5084; 1-866-431-0511 and 1-800-261-1392 on October 19 and I had no luck getting through to a live agent on October 19. I also sent a written notice of a similar shorter letter as this one by mail. I also contacted your company electronically through your company website and received no such response upon this matter, electronically or by phone. On November 11 I contacted your company Help Me To Buy again, contacting the three numbers above with no luck in reaching a customer service representative. However, I did get through a different number a fourth attempt at 1-888-202-3291 and spoke with LaTonya, Agent #: 1272. She verified my current address in Staten Island, NY, but failed to verify my previous addresses. I stated with this agent that I felt that I am entitled to a full refund and she disagreed because she said that my account had been in default since February 5th. Then she stated that I never contacted the company except on February 5 for payment. I disagree with her response due to the fact that in order to follow-up with my contract I have to contact your company multiple times to keep up with my account. She states that there was no report with your company that I wanted to change my mind and request a cancel in February. I do recall that I wanted to change my mind and request a refund several times prior to February in March and in January due to relocation and unemployment.
In your the FAQs online it states, how long it will take to get my computer? Your companys response is that, Once you have completed your layaway payments we will offer to finance your computer. Then just allow 3-4 weeks for shipping and handling and your computer will arrive by a company like UPS or FedEx. This is false advertisement. I had paid into my account for the first 10 weeks and received no such computer package after 5 bi-weekly payments. I contacted your company about my shipment and was told I had to wait for a contract by mail which I understood as my final contract to receive my computer. I was told to continue to pay bi-weekly payments of $99.00 for three more bi-weekly payments and wait for my shipment and new contract from a new finance company. I paid the extra three bi-weekly payments on-time and never received a shipment of my computer package or new contract.instead of receiving my computer package, I received another contract from your company, very similar to the first contract to finalize my shipment. I sent it back and waited the additional 4 more weeks and I still received no shipment on my computer package.
So, I paid 13 weeks of bi-weekly payments of $99.00, what the representative stated on November 11, was that I only paid $998.82. I am confused as to where the other $288.18 of the payments I made went to. She also stated that I am not entitled to a non-cash refund because I was default February 5th. She also stated that your company does not issue cash refunds. I stated to her that at the company website online it states that if I change my mind I can receive a full refund. She also stated, I do not see that anywhere online about that, but you have to be in good standing and no default to receive the refund. What she stated goes completely against what your company states in your Facts, Answers and Questions.
The F.A. Q stated online asks, If I change my mind can I cancel purchase? Your companys answer, If you change your mind prior to the computer being ordered from the manufacturer you may cancel your purchase and qualify for a refund. No where in the FAQs does it state that in order to receive a refund that I have to be in good standing or in no-default, as LaTonya, Agent #1272, stated in our phone conversation on November 11. I do recall stating that I changed my mind and requested to get a full refund, but she states during this phone call that the only time called in was February 5th and an email on November 8. This also is incorrect.
The representative I spoke to in January was male and the phone number he gave me to contact him about my account was 1-800-261-1392, which is no longer in service. He stated that I was unable to receive a refund and to continue to pay to receive my computer shipment instead. This leads me to suspicion that your company is a fraud and you lead innocent people who want to build their credit and instead lose out on a too good to be true program.
In closing, I paid your company $1227 into your Buy a brand new computer or HDTV with bad credit or no credit history! Program. I followed the instructions in order receive my computer bundle, waited diligently and patiently, and received no product, package or merchandise for what I paid for. I requested a refund before any so-called merchandise was shipped and changed my mind and was refused a second time because your company said I was in default a year later. I am a very unhappy customer and I will not be swindled for my hard earned money just to pay your company for a program that is too good to be true. I am unsatisfied with the results of paying on-time and paying so much money into a program that I thought would help build my credit with the credit bureaus, upon my request. That your company states that you do not check credit, you are not a credit finance company, nor rental or leasing company, but you pose as one to help people like me to afford such merchandise that is never received. I took advantage of your Skip-Pay program several times which kept my account in good standing until February. Then your company refused to issue a refund because your company does not issue refunds.
This contradicts your policy in two ways. You state your company does not issue cash refunds and that you have to qualify for a non-cash refund.in order to qualify for a non-cash refund you have to be in good standing and not in default. One, I was never in default because I took advantage of your Skip-Pay program that kept my account in good standing which entitles me to a full refund. Two, your company states that IF I change my mind, which I did, prior to a computer being ordered from the manufacturer, which never was shipped, that I may cancel my purchase and qualify for a refund, that now is told I have to qualify for my refund. I requested a refund and it was never reported on your end that I wanted a refund. That I was instead told to continue to pay because you do not issue refunds. This statement goes against your facts.
Therefore, I expect to receive my full refund of $1227, that is $998.82 plus any start-up fees I paid into the program. This is due to your companies lack of communication, miscommunication and misleading advertisements, false advertisement and payment with no receipt of merchandise or shipment upon your company receiving my payments. If I do not receive my refund, I am reporting your company to the Better Business Bureau and the FTC for bad business practice and fraud. Since, I cannot submit my claim through your affiliated company NAC (National Arbitration Forum) I will obtain my refund through another source. I seek a response promptly regarding this matter."
I hope other people read my report and work hard to get their report read by a legal advisor/lawyer to help get their refunds back from this fraudulent company.
