Never sent phone I ordered for daughter's Christmas gift

I ordered a cell phone from E-bay from moresells.com. I paid for the phone on December 9 and received an e-mail on December 10th advising me the phone had been sent Priority Mail. On December 18th, I e-mailed the seller informing him the phone was not received. A day later, he e-mailed me the tracking number which was no good. I e-mailed again, he said he would check on it, but never gave me any information other than the tracking number over and over that was no good. He did mention in one e-mail that he would send another phone, but all of my e-mails asking when went unanswered. This phone was a gift for my daugther for Christmas so I became frantic Christmas week. I called the post office, went to the post office (during the Christmas rush) and they indicated he had indeed printed a shipping label from his computer but the phone was never scanned in, so never shipped. Between contacting moresells.com over and over, Ebay, Paypal, the post office, my bank... I probably have 4 hours invested in looking for the phone that I dod not have to this day.

On December 21st, I got an e-mail form moresells.com through E-bay "guaranteeing" me the phone would be received by Christmas. I called the phone number 8 or more times and left messages, but never received a call back. Phone never arrived, and I was unable to order another one in time for Christmas which was a huge disappointment for my daughter. If Moresells had been upfront about not shipping the phone on the 18th, I could have re-ordered from someone reputable and had a phone in plenty of time.

I finally received a call from "Brian" today (a little late!) apologizing that the post office had lost my phone! I find this hard to believe as the USPS went out of their way to try to help me. If the company had indeed shipped, why no return call or e-mail assistance BEFORE Christmas. His answer was "We were really busy, which is a great thing!" Great for the company, but not for the person that ordered and paid for merchandise that was NEVER received! Brian did indicate he would contact PayPal and refund my money today, but I got yet another lame e-mail tonight about why he was unable to refund me.

Here is where I stand today... He has my money, I have no phone, I spent hours trying to track down the phone that was never shipped! I have had to go to my bank and fill out a mountain of paperwork to dispute and most disappointing of all... My daughter's big present was not under the tree and I cannot get her one until I have my money back for the phone that was not received.

I would NEVER deal with this company again. I cannot believe they ignored my frantic calls all Christmas week knowing I was waiting on a gift they "guaranteed" would arrive. If moresells had indeed shipped, why ignore me? I guess I should be glad I did not get the phone... If there had been a problem with it, I am positive I would have not heard back from anyone and it would be harder to get my refund.

I have never had one problem with E-bay until this guy. I would not buy anything from him... Too many reputable people out there to put up with this runaround and ignored calls. I feel totally ripped off.
