I contacted Geana & Associates in March to contact nine creditors regarding making settlent offers. I was quoted 15 months at a payment of $351.91 a month to put in a separte checking account and as they contacted the creditors and made settlements I would make the payment to my creditors. I was to send my first intial payment to them for them to get started. I did along with my information on the accounts that they would be trying to settle.
I was told that my debt would be settled in 15 months. I sent them my first payment of $351.91 to get the process started. They were able to settlement one account for me. I was told to send that first payment to them and they would forward it the creditor. Which I did. Then two days later I was told that I owed a 25% negotiation fee, so I sent the additional money.
However when rereading the contract I signed that money should have been took out of my intial payment to the company. I contacted the second person now working on my accounts in less than two months and asked why I had to pay more and he said he wasn't sure he thought that it should have been taken out of my intial payment too. But he was told that my intial payment was a set up fee. There is nomention of a set up fee in my contract.
I should have known at that time this company was fishy. I came across some money and paid four of the original accounts that I sent to them out of that money as I was told to go ahead and do when I contacted Geana & associates. They said to try and negotiate those debts myself. So I did.
So now they have a 25% fee plus my original payment and have only negotiated one debt on my behalf out of nine and there is now only four left. I contacted Geana by fax anytime I recevied and invoice or a letter in the mail regarding the accounts. One debt in particular was immediately sent to collections. When the collection agency contacted me I told what I was doing and gave them Geana's phone number, and then I faxed the collection information once again to Geana and also telephone David Jussen regarding this account and was assured that he would contact them, a week or so later the collection company was calling me again, I explained to them once again about Geana and they said that they had not been contacted by Geana and then demanded that I pay half the debt within two days to keep it from going to court. Of course I did not have the money I was paying on the one debt that was negoiated and forward all additonal money to Geana to pay the fees.
Two days later I received a letter from an attorney regarding this account and I contacted geana to get dates that they contacted this particular creditor. I was given only one prior to the collection agency being involved and none after, Even though I was assured that they would contact the collection agency, It never happend. I contacted the attorney who was unwilling to negotiate at all. He informed me that I should have try to make a deal with the creditor before it got this far. I explained to him that is what I thought Geana was doing for me. I ended up filing Bankruptcy, I figured that my credit was beyond repairable at this point anyway.
I have since contacted Geana on numerous occassion regardign my intial payment and demanding a refund. I have got two telephone calls back on my home phone when I was not home to take the calls. Each time I have called back and left additional telephone numbers to be called back at and have not been contacted at any of those numbers. And to this date have not been reimbursed my intial payment, which may not be a lot but it is to me. All of this happen less than six months. I am thinking of going therough the hassel of a small claims action against the company.
