Lied about amount of payment for shops and even then, they never follow through on payment

I completed two pay advance shops for this company. Within the instructions, it stated that "there is no compensation other than the reimbursement amount for a $100.00 payday advance." The shop instructions also stated that I would be reimbursed the $15.00 fee to obtain the pay advance and that I would be reimbursed within 30 days of shop completion.

After the first 30 days I called the company to inquire about the status of my payment, I was told to leave a message for Ms. Johnson, the owner. Which I did and did not receive a call back. A week later I called again and was told that they were behind in processing and shops completed in that month would be processed the third week of November which was about two weeks from the date of that call.

I called again the fourth week of November to state I had not received payment and was told by Justine (the individual answering the phone) that she would check with accountant and call me back in 15 min. Four hours later I called back and was told by Justine that she had not had a chance to speak with the accountant and that I should call tomorrow. I called the next day, and was told that my check for the full $230.00 would be mailed the next day.

A week after "the next day" I called to let Justine know that I had not received payment, she told me the accountant was out until the next week and too call back on Monday. I called on Monday and was again asked the dollar amount I was owed. When I stated $230.00, Justine told me that I must have misunderstood the instructions of the shop, as they would never be able to afford paying everyone for the amount of the loan plus the fee. When I quoted to her the verbiage as stated in the instructions, she said that I must understood, and that despite what is clearly written in the instructions, they would only reimburse the $15.00 fee, which for me totaled $30.00 for the two shops.

At that point, I asked when would the $30.00 be sent, as it is beyond 30 days. Justine stated that it would be another few weeks. Just to make sure I heard her correctly, I repeated, despite the agreement to pay me $230.00 within thirty days, you in fact are only paying me $30.00, and that is only whenever you are able to get to the processing? She stated, "Yes".

Clearly this company has breached a contract with me, one of their independent contractors. They about the payment amount and lied about the pay date. Could it be a scam by the "client" of Check Mark, Inc. To increase their business? I am quite sure that if I had breached my contract with them and given away my identity to the "client" as a mystery shopper, some form of legal action would have been taken against me. Well they have breached their contract and have not paid me the amount they said they would in the time they stated they would do so.

I believe I would be well within my rights to take legal action against them. This company should be stopped. These pay advance shops are indeed scams. You will not be paid. Sixty days after the shops I am still waiting to be reimbursed the $30.00 in loan fees Justine told me would be coming a few weeks.
