Sold me a scooter that overheats, had physical damage in shipment, and now no ignition to spark plug

I purchased a Tank 250 touring bike from Win Win Auto Group May 3rd 2007. When I first assembled the bike I noticed the fill tube to the radiator was broken and there was physical damage to the front fender. I contacted the company to get a warranty part and make them aware of the physical damage. They told me that cosmetic damage was not covered.

3 weeks later, after sending them the old part, I received the new one. The coolant system was thoroughly filled according to the company criteria. I went on an excursion and after about 10 miles noticed that the temp gauge was starting to get too high. I stopped to investigate and found that the cooling fan shroud (made of plastic) had melted and locked the fan causing it to short, leaving me stranded on the highway on my first trip.

I contacted the company and spoke to someone named Chris in customer support on 7/8/07 and was assured that the part would be sent priority mail. I contacted him again on 7/13/07 and he now tells me the part is not in stock. My postmaster told me the part shouldn't take over 3 days from Wichita. At this point, I have over 8 hours of my personal time involved in repair of this so called new bike. The above written statement was sent to Wichita BBB.

I finally received the parts and found the fan shroud was broken already.in order to avoid any further downtime, I purchased an after market fan which produced nearly three times the cfm of the original. The bike continued to overheat. I contacted a bike shop locally who was authorized to repair Tank scooter. The bike stayed in their shop for over 3 months with no success. They had individual mechanics look at the problem and they all concluded there was an issue with overheating but had no answers how to fix. The bike shop told me if there was any further correspondence with win win auto group, I would have to do it. They had pissed off the mechanic to the point that they quit calling them for advice.

I had contacted Tank in California on several ocassions involving the issues and spoke with a guy named Donnie but he told me the problems would have to be resolved with win win auto group. I did this because win win said this was no longer an issue they would help me with. I needed to go back to the manufacture. Moving ahead, It's now December 9th and here in North Carolina we had an unusually warm day so I thought I would try to take the bike for a ride and see what would happen. I started it up and it ran for about 5 minutes when suddenly it "Died" and wouldn't restart.

After 3 hours of troubleshooting (I'm an electronic Tech.), I determined that the CDI package has now failed. It's now 12/14 and I now have to return still another part and wait for a warranty return. I have filed a complaint with Seneca County District Attorney in Wichita but now they won't even respond. I'm mentally exhausted from this nightmare. I wrote this in response to "Mary" from Omaha and her ordeal and how much it sounded exactly like the situation I had. I Want My Money Back and win win can pay for whats left of this bike to be returned to them.
