The following letter was sent from my attorney, Alan Docterman, to AmeriTrain's headquarters in King of Prussia, PA and to KeyBank in Boston, MA, on August 21:

Dear Sir or Madam:

Please be advised that I have been retained to represent Jay S. Figer with regard to his contract with Ameritrain for computer training. This training was partially financed by a Key CareerLoan obtained for him.

Mr. Figer contacted Ameritrain at its Tyson Corner branch and met with the regional manager, David DeConcini, on June 3. He signed an Enrollment Agreement for 136 hours of training in Microsoft Windows 2000 MCSE and Microsoft Exchange beginning July 22. The total charge was $8300; he paid $830, leaving a balance to finance of $7470. Mr. DeConcini arranged for financing with KeyBank, with whom it had an ongoing relationship. KeyBank apparently also added a loan fees charge of $373.50. When Mr. Figer spoke to Mr. DeConcini about one week before classes were to begin, he was informed that the instructor had been mistakenly scheduled elsewhere and that the commencement of instruction would be deferred to August 27.

Last week Mr. Figer called the Tyson Corner location and was informed by the secretary that Mr. DeConcini was no longer employed there, that the office was being moved, and that the start date was uncertain. Mr. Figer then called Steven H. Gouveia, Vice President of Ameritrain, in King of Prussia, who was unclear about the status of the Tyson Corner office or when classes would commence. Mr. Figer checked the website of Ameritrain, and contrary to the representations made, discovered that the Tyson Corner office had been closed. Mr. Figer then learned from the Virginia State Department of Education that the office had recently received a series of complaints from students regarding the closing of the office and the cessation of services.

It is evident that Ameritrain has engaged in a course of unscrupulous and deceptive conduct. For the reasons set forth above, which include but are not limited to, breach of contract, fraud, misrepresentation and violation of Truth-in-Lending, Mr. Figer hereby cancels and rescinds the contract entered into on June 3. Demand is hereby made for return within ten days of his $830 deposit and his two payments of $134.46 to KeyBank. The sum of $964.46 should be sent to Mr. Figer at his home address: 7213 Hidden Ridge Ct., Springfield, VA 22152.
