Thieves and Frauds ripoff

I am a victim of a fraud committed by First Data Leasing and Wells Fargo Bank. I signed up for the merchant services with Wells Fargo back back in October or November. I spoke to a Wells Fargo representative named Gibson. I sat and signed a very short contract for the merchant services and leasing of a credit card machine for 36 months.

As soon as I left the premises after our meeting, I remembered that Gibson never gave me a copy of the contract, so I called and left a message asking her for a copy. She never got back to me. I left numerous messages and e-mails, but she never called me back.in February, my business closed.

I called Wells Fargo to find out about the merchant services and the credit card machine, but again, nobody was able to help me and just gave me the run around. I called First Date, the credit card machine leasing company working with Wells Fargo, to take care of matters myself and I was transferred to a very rude lady who did not know how to even make the easiest calculations, or give me a straight answer on my account. She also said that I signed a 4 year contract, which I know I did not.

When I asked her for a copy of the contract, she took two to three weeks to get me one. When I received it, to my shock, I got the 1st and 3rd pages of a documents. The last page which contained my signature, was a form page with disclosures written a very tiny letters and just my signature and date.

The first page was a typed written page with with someone else's hand writing on few of the lines, and many of the critical information contained such as address and SS# were incorrect. When called First Data after receiving the copy, and I asked where the second page was, the lady said that there weren't any.

If a page says page 1 and page 3, how can they miss page 2? Well, to make a long story short, this is not the contract I signed. The signature in the last page is mine, but the first page was definitely not the one I filled out and signed.

When I told this to the woman, she threatened that she will report me to the credit agency if I don't pay her then and there, and did not even bother to find out about the contract altering. It was like she already knew that something was wrong, and did not care to discuss. And of course, Gibson from Wells Fargo is still MIA.

To make matters worse, until I get to the bottom of the problem, I was paying my monthly fees by check, since my checking account no longer exists and which I specifically told the First Data lady that I will be making my payments by check.

To my shock again, two months after, I get a bill for about 30 dollars 50 dollars in collection fees because my bank rejected the automated payment. Now, aren't they thieves by getting my checks every month, plus attempting to withdraw directly from my bank account?

Rather than resoving the issue, all an employee of this company can say is "pay me, " pay me, " pay me, " or "I'll report you to the credit agency." They even had the audacity to say that even though my SS# they have is not a correct one, they will easily find out the right number and report me.

Is there an attorney who can take a case against First Data? With all of the people affected by this company, I think we have a Class Action suit waiting to happen.
