Greenpoint - conseco professional rip off artists

We bought the modular home in aug. At that time greenpoint held the mortgage. They sold it to greentree and conseco bought the greentree corp. The interest rate at that time was at 11% which is still higher than it is now.

For some reason are payments are $3. Rounded off from what it is now. I think they have made a big mistake on this arm loan. I know the interest on this loan has not gone up that much. U have also notice that there is always a extra amount on the payment if it is late of $10 each month there is no explantion given for that charge and our contract says they can not charge more than $5.00 late fee each month.

There is nothing in the contract that says they can charge any more than that. A fee months later they say we owe late charges at 5 dollars at month. What is the extra charges? They are also talking to my POA without written permisson from us.

Both of these are comsumer protection violations. They are also calling my neighbor phone which is a business phone. She has asked them not to call that number again ir she will sue them. A few months later they call there again she said she will be contacting her attorney to sue if you call again and that she has already advised him of this situation. They finally quit calling her. These three are comsumer protectionviolations i believe.

They had started to call at first one time a day and now it is five times a day and sometimes more they also leave voice messages on there cell phone. On january 26th of 2007 my POA called them to tell them i had been involved a bad accident with fatalities in another state after that was said. Three days later they started to call more often and it continued to get worse.

I was only 13 days late at the time when that accident ocurred. The account was up to date in december. The payment was going to be made the following week. We told them he had no money at that time and that he had to wait for workmans comp. I had told this to four different people and one said the she would note the account to not call every day.

Two hours later i got another phone call the person i had talked to told me that he did not care what happened while i was talking and all i want is my money. I told him he is not going to get it right now not until my workmans comp comes in which will not be untill sometime in february. He said he would not accept that. He said all i want is my money or make arrangements to pay it right now.

I told him that the arrangements have already been made. He said there has been no arrangments made for you to send my money. I then asked him to read the notes to me on the account. He read them to me and it said do not call this number and do not call me every day. I said does that constitute calling me two hours later. He then said all i want is my money. I am sorry you will not get it until the workmans comp comes in. And as far as i am concerned this is a violation of the consumer protection act with you calling like this. He said he could do anything he wanted.

Already today they have called here 5 times between 814am and 12:15pm and they have left one voice mail in the middle of these calls. They are also demanding information on bank accounts i keep telling them i dont have any. I pay my payments with postal money orders and they told me they dont accept them any more. I then asked him why they have always accepted them in the past and why was i not notified of this change.

There is never anything in writting from them unless they come by the house and tape it on the door. The letter starts out saying this is not an attempt to collect a debt. Then why is it that they come to the door and leave somthing like that if it is not to collect a debt. I was not home at the time. And the letter said that they wanted me to call to make payment arangments.

AT this point my POA has told me to take the whole account to the CPA to get the loan figures checked out and i am going to get an attorney to help us or going to go with a company called ACORN. It is a national organization that hwlps low to middle class people. ACORN has already brought conseco to federal court on simular violations. The costs are a $ 120 a year. For more informatin on this organization you can get them thru there web site acorn.

I do agree with all of you we do need to do something with this company or should i say companies so they can no longer do this to people. A class action suit would be ideal. You can get the laws at the federal trade commission FDIC: FDIC law, regulations, related acts-consumer protection. Now we need to find someone who will tell us what we need to do for a class action suit.
