I am in the design stage of my project with davison inc. And its not going well. I, like hundreds of other people, have experienced disatisfaction with there services and work relationship.in fact, they have presented themselves to be somthing there not, and have commited themselves to do somthing they cant.
Davison called me today regarding the design stage status - rick smith (davison) said that the design stage would be done by the end of next week - (9-30-05) which would make it a 14 week project - 12 weeks was projected - since they just started last week, this means the whole 3 months that ive been waiting has been for nothing - they will probably do the whole design project in about 1 week. I am not very happy about their services and them fullfiling their agreement.
I asked him (rick smith) while i was on the phone if he could give me the disclosure document filing # - he said it would take him a week to get. I already have the number which i got in 5 minutes when i called the uspto - he questioned why i was asking for it and asked if i was working with an attorney. His attitude changed for the worse at that point and became short and rude. I stated that it was not his business if i was or wasnt working with an attorney. If he does not fullfil his commitments according to our contract, then contacting my attorney would be my objective.
Today i also talked with davison (rick smith) about the design of my project - i told him that i did not want to change the design of the project from its original design - he said no, we have to because it would be more cost effective to have the%be the same shape and size and that they were going to sew the pieces on the % - i stated that i disagreed with him, and that i wanted it to be the same as the original design i sent him. He said that i would have to give him more money if i wanted it that way. As he got more disgruntled, i told him that i would have to see the final design before i aprove - only because he backed me into a financial corner and i new at this point i wasnt going to proceed with davison because of the research i did regarding all the complaints, litigation, and the ftc's reports. I will not give them more money but i will proceed with what i have paid them for and that is to get davison to design what i want and own, the way i want it.
Like everybody else. Things are starting not to add up...
1. Calling me on the 12th week to ask me if they can change the design when it was a projected 8-12 week process anyway. (which means the 3 months i waited, thinking they were working on it, they wern't and they just got started. Even though they called me every month saying they were working on it)
2. Me telling them no, i do not agree to change the design and davison coming back with, i would have to send them more money to have it designed the way i wanted (even though i sent them my original design at the start when i first contacted davison)
3. Telling me that the design change would reflect that the pieces would be sewn on... What?
4. Telling me that it would take a week to get the discloser document filing # from when i asked for it on 9-23-05. (i still have not received it from davison)
5.2 documents from davison (even george himself) states that they will cover the cost of a patent application and the and be responsible for the filing costs, but when i talked with them several times about it, they stated that part of my $12,000 pays for it... Which one is the truth? And what am i paying for?
6. Also, why are you saying that i need to give you additional $100 for the filing fee then?
7. When i asked, "what if your patent search reflects similar products to my idea" and them stating that they would proceed anyways. (why would anyone continue to design and produce an invention that already exsists!)
8. When i received my "3d renderings" after the design stage was finished i was appalled. I could not beleive my eyes. I got 1 sheet of paper showing a computer generated picture of somthing that looked like my invention hanging on a store shelf, thats it. I didnt even know what it was, for it reflected no detail or description. I cant believe i spent $7,000 for that kind of work. There commitments are misleading and false about who they are and what they can do.
9. When i asked rick smith about my design and told him that i wasnt going to approve my 1 sheet wonder, thats when things went bad. All i asked is that davison send me more information. I wanted drawings refelcting details of my inventions purpose, functions, features, demensions, materials, and any other specifications they had. Rick smith said no to my request and refused to send me that information. He said that the one sheet he gave me was all i need and that it had enough info for me to approve. The computer picture he sent me was not even my invention. It was evident that very little time and effort was put into it. The fact that they refused my request just means that they didnt have that information or the resources to get it for me. So the conversation ended with me not willing to approve my $12,000 investment off of one sheet of paper, and davison refusing to send me or give me more information detailing this computer drawing they are calling my invention.
10. When i asked davison to send me my drawings and prototype back, he stated that he wouldnt unless i sent him a pre-paid package that he could put it in and send back to me.

Answer: 10
2. Do you feel you have fullfilled your part of the contract regarding your completion of the design stage?
Answer: yes
3. Do you feel the finished design and the information sent to me to approve, clearly resembles my invention?
Answer: yes
4. Do you feel that the information you sent me to approve, clearly specifies in detail, the functions, features, purpose, materials, demensions, and the specifications of my designed invention?
Answer: yes
5. WHERE DID MY 7 GRAND GO TO?
ANSWER: to the 3 D rendering
My response: i will not approve this picture. I did not send you almost $7,000 so far to get one picture back reflecting my so called investment. You must be a fool to think that i would approve my 12k dollar investment off of one sheet of paper. This does not give me any information at all. I cant even tell what it is or does! This does not resemble my idea and has appears to have functions and features that i do not want or agree with. I really wish i knew what this drawing was and what the specifications are.
(RICK SMITH RESPONSE: he stated that he will not provide me with any drawings or any more information. He kept asking me why i needed more information or drawing specifications. That the one page computer print out is enough. He stated that i need to give him more money to produce a prototype according to the contract. He said that all the complaints i researched were not legitimate and the FTC is not accurate in their accusations. He asked if i had an attorney and said according to the contingency agreement that i cant hire one or have one represent me. He said that the computer print out is just an example of what the prototype may look like and at this point could change during the process.)
Here are your options davison: remeber that you work for me, i have hired you to do a service for me... Your contract states things that you have not given me or are willing to give me. You are contradicting your agreement and are in breach of your contract.
I will not approve any pictures or drawings until im am fully satisfied with the design.
Option 1 - provide me with documentation clearly specifying the functions, features, purpose, specifications, material description of the design in details. Mail the drawings to me to see if what you have so far is even somthing i would approve.
Option 2 - like hundreds of other people have done, i will contact the ftc, the uspto and the bbb and my attourney to file more complaints and pursue more litigation requesting a full refund and to have my contract cancelled.
Rick called me today regarding my one last request of him sending me more drawings and info for me to approve. He still said he would not send me more info.in fact he said he didnt have any drawings to send. That information of the project is not available. (so the truth comes out) - im not sure why its called the design stage and why it cost me $7,000. If i new all i was getting was one incomplete drawing, i would not have even used davison. I told him i wanted the design to be the same as i sent him at the start, and he refused to design it my way. He said, "if i wanted a prototype of my invention then i should have hired a production firm" i cant believe that i payed for this type of nonsense. He was very rude and continued to refer back to the contract. He made smart ass comments about me and my lack of knowlege of inventions and this business. Im done with them, except getting my money back.
