If I had not found this web site, my wife and I might be in more difficulty and wasted a lot of time.
Our mortgage was flipped from GMAC to ASC effective July 1. Our first clue to their dishonesty was when they told us our mortgage was now $400 more than our contract.
Armed with legal information and help from this site, we both called them the following day. I prefaced the conversation with information I knew were under federal investigation for predatory mortgage serviing and the Internet had pages of complaints against them, which to me as a consumer was alarming. I stressed that I did not want to follow in the footsteps of others who had problems with their company.
The rep tried to give me a story that our insuarnce caused the additional amount. I found the best answer to these people is, "You can't do that, you're breaking the law."
The rep changed the loan back to its original amount and my wife verified that on their hotline. However, they still have us owing July 1 despite the check beng cashed.
When they could not "find" the check&my wife told them her bank computer screen clearly told her the check had been cashed. She also happens to work at the financial institution where our mortgage check is drawn, so she has an insiders perspective on their actions.
The rep told us to have our insurance agent fax them our authorization today. He is another ally. I plan to follow up today and tomorrow.
I know they recorded the conversation&as that's what the do at my wife's financial institution. Though they say that is for quality control, it is really more to avoid lawsuits. My wife's organization is one of the premiere credit unions in the country with a powerful Washington D.C. Clientele. The really do use their monitoring system for quality control.
I'm keepin a log of all this - but I don't plan to waste a lot of time with them. I plan to turn it over our situation to law enforcement if this trend continues over a two week period. The U.S. Attorney is doing a massive investigation of predatory mortgage lending and servicing as is the F.B.I.
We would appreciate any help we can get on this. I noted one complainant had a lawyer in Md. Who prevented his house from being foreclosed. I would certainly be interested in his name, or the names of any class action suits.
I would also be interested in knowing what role the press has played. I do marketing intelligence work and have ways of getting to the press - just don't have a lot of time to do it.
