I believe we were scamed and we have been trying for four weeks to get our vacum cleaner returned fo, but for some reason the company doesn't know where it is

On July 28 a young man came to our door and asked if I use Kleenex tissues and handed me a small package of tissues. He said, "Today is save your sleeve day". He told me he was doing a survey and his boss would pay him $30 if I answer another question for him and I said okay. Then he said I have to run to my car and get some things first. He returned with a Kirby vacuum and accessories and never asked if he could come into our house, he just went in. He wanted to show us the Kirby, and I told him he could demonstrate but that I was happy with my Dyson vacuum cleaner. He said that was fine but he had to do the demo to be paid.

To make a long story short, my husband and I (because we are such push overs) ended up with a Kirby vacuum at a reduced price from around $3500.00 down to $1400.00 and our Dyson was given as a trade in. After the young man left, we discussed what we had done and felt that we were pressured to buy. According to the contract, we had three days to cancel the sale, and we cancelled it the same day. Before the company sent for their Kirby, we were asked if we would reconsider and purchase the vacuum at a lower price. My husband asked how low and the lady said $400.00. He said no and asked that our vacuum be returned. It didn't make him too happy that in the beginning they sold it to us for $1400 and then decided it was only worth $400!

My husband paid the bank $20 to stop payment on the check, which was a good thing or we would probably be out the $1400.00 too! Also, according to the sales contract, the seller - Cheyenne Distributing, Inc. - had 10 days to return our vacuum, and if they did not pick up their Kirby within 20 days, it was ours to keep. My husband thought that we should keep the Kirby until our Dyson was returned, but also stated on the sales contract was if we cancel, we must make the Kirby available to the seller. We have been trying to get our vacuum cleaner back, for about four weeks, and keep getting the run around.

The lady we talk to at Cheyenne Distributing can't ever give us answers as to what happened to our Dyson. Several times she told me she had to check with the main office in Loveland, CO, to track it down. Finally last Monday, 8/20, I was told the company would be sending me (on that day) a different Dyson (via UPS) used but like new. As of today, 8/27, I have not received the vacuum. My husband and I have called the company just about everyday for the past two weeks because they will never return a phone call. We asked for a tracking number on Friday 8/24, and she could not give us one. So, as it looks at this time, I will probably be spending money for a new vacum when I had a perfectly good one before.

We take the blame for being gullible enough to buy the Kirby vacuum when we didn't need one. However when you deal with a company that gives you the opportunity to cancel a sell within three days, and you fulfill your obligation to return the merchandise, you expect them to do the same.
