I placed on on-line order with Sears Home Center 04/07/08 and paid in full with my credit card. The invoice included $167.50 for shipping and handling of furniture. The furniture arrived in good condition on 05/28/08.
On 11/29/08 I received a demand for payment letter for shipping the furniture from the freight company. The demand amount is $156.80. The freight company claims that Sears did not pay the shipping invoice.
The freight company claims they have a legal right to demand payment from me. Here is their quote: "You are being billed under the CARMACK Act (cite: 49usc10743) of Title 19 Transportation as Sec 10743. Liability for payment of fees.."
I have called Sears Customer Service. Sears Home Center no longer exists. The representative took down my information and said someone would be in contact with me in 48-72 hours.
I sure hope that Sears really follows through.
