Fraudulent Real Estate Sales by The Real Estate Company

In November my wife and I moved to Missouri from New Hampshire. Because of the move, and the fact that we would be starting new jobs, we would have had to pay nearly 13 percent interest on a mortgage, but the "good people" at Greenleaf had a quick and easy alternative. They would sell us a house with 30 year fixed rate financing at only 7% interest.

What a wonderful deal. We looked at the houses, picked one that my wife fell in love with, signed the contracts, paid our down payment and moved in. I required that the Contract for Deed be recorded, and after a little wrangling, it was done. Before buying, I did my due dilligence and found that the property I was buying was actually titled to a Thomas Hollis in Bolivar, Mo, and that Greenleaf didn't own the property they were selling. So, again, I required that there be some affidavit from the titled property owner stating that Greenleaf was selling the property on his behalf. Again, after some wrangling, the true owner signed an affidavit that Greenleaf was marketing the property on his behalf. Lo and behold, we are now property "owners."

We have made our payments of over $1800 a month faithfully. They are being reported on our credit bureau files, so all was going according to plan. Then in July, we accidently opened a letter addressed to Thomas Hollis from the mortgage lender. It stated that the note had not been paid, and was in default. We immediately contacted the titled owner with our concerns, and he responded that he would personally see to it that the payments were made in a timely manner. So again, all was well.

Last week we once again received notice that the owner is late on his payment. We have notified him and Greenleaf by certified mail of our intention to sue if they don't keep up their payments. They have not responded. We have filed complaints with the Better Business Bureau, the Attorney General's office, the Nixa Missouri Police Department, and the Missouri Real Estate Commission. On Monday I will meet with our attorney to commence litigation for damages. We are currently negotiating through our attorney with the lender to take over the loan. Our attorney drafted a document which he filed with the recorder's office, so if coreclosure begins, now they have to notify us as well.

In my opinion, this activity by Greenleaf Properties, L.L.C. Is unadulterated fraud. I will take whtever steps necessary to see to it that this company is closed, their real estate license revoked, and their principal Scott Dasal is indicted for fraud.
