Warranty not Honored

Complaint: ProHome Warranty Service and Chesapeake Condominiums.
Refuse to honor warranty.

10Aug08. We purchased a Condominium from Chesapeake Condominiums. During the initial sales pitch and during the walk through inspection we were assured by the salesman Mr. Tim Jones that all appliances including the air conditioning were new and covered under warranty. With this purchase we were issued a booklet titled Homeowners Manual and maintenance guide.in this booklet is outlined all of the items covered under warranty by the builder.

3May08 The air conditioning in our unit quit working.
5May08 My Daughter Miss Kranendonk (resident of unit) called ProHome and was told by Christine to hire a repairman because it was a homeowners responsibility. She called Air Care Cooling and Heating co. To Make the repairs. The technician found the problem to be a refrigerant line leaking. They made the repair and charged her $520.00.

Miss Kranendonk contacted Arlene at ProHome and informed her of the findings and that the Homeowners manual stated on Page 25 code AC2 The builder will take corrective action if refrigerant lines leak during the term of the builders limited warranty. Arlene told Miss Kranendonk that this was correct and that she would contact a the air conditioning people.

7May08 Miss Kranendonk faxed Pro home the invoice for the repairs and attempted to contact them.
8,12, 14 May08. Miss Kranendonk contacted Pro Home and each time was told they are working on it.

4June08. After waiting for three weeks Miss Kranendonk contacted ProHome and was told that they were not going to reimburse her claiming that the air conditioning was not in the warranty.

5June08 Mrs. Kranendonk (My wife) called Pro Home and asked Christine why they were not reimbursing this expense. She was told the air conditioning was not covered under the warranty. When Mrs. Kranendonk read to her the text contained on page 25
Code AC2 of the homeowners manual she stated that Prohome was just an in between reference and that she would have the builder call us. Mrs Kranendonk later called Arlene at ProHome and was told that the unit was not new but was installed in 2006 and was no longer under labor warranty. But possibly could be covered for parts.

9June08. I contacted Arlene at Prohomes. She stated that they were not going to honor this part of the contract because the warranties on all of the units expired in 2006. I reminded her of the text on page 25 of the Homeowners Manual and of the technicians diagnosis.
She then stated that this is a generic type of contract and that the builder can pick and choose which parts of it he will honor. She reffered me to Mr. Danny Parra at Fusion Design&Development.

11June08. I sent an Email to Mr. Jeff Meyers (Listed as CEO of Fusion) I explained the situation and requested reimbursement for these repairs. I contacted Danny at Fusion and asked him were they going to make good on this warranty or not? He said He would not.

12June08 I sent an Email to Mr Jack Salmans. CEO ProHome International with a copy of this complaint to date.
