Ripoff Programmed Software Fee of $500 for Termination of Contract Safe Touch expects you to return the software loaded to the computer within 96 hours of termination of contract

I purchased a full security system from Safe Touch Security (STS) in Jacksonville, FL in June for $1034. Because I paid for the system up front, I had no monthly charges for three years. The salesperson told me that if I moved prior to the end of three years, I just needed to notify Safe Touch that I was moving and that the system (which I owned) would belong to the new owner.

In July I informed Safe Touch that I was selling the house and moving. My contact by phone did not illicit a warning that I had to return anything. I informed STS by phone and letter my intent to sell and relocate.in April I received a demand debt collection letter on behalf of Safe Touch Security stating I owed over $1,200.

When I asked for an explanation of the charges, the information I received back stated I owed $500 for Programmed Software and no explanation for the other charges. Upon reviewing their reference to the $500, I found in VERY small print on the back of the contract: "The programmed software installed in the computer shall remain the property of the company.in the event of discontinuation, for whatever reason, the Client agrees to return software to the company. If software is not returned within 96 hours of discontinuation, Client agrees to pay Company $500 for the software plus legal fees necessary to enforce this provision."

My itemized list of equipment on the contract did not include a computer. There is no reference to software on the front of the contract. I have no idea how you return software that has been downloaded to a non-existent computer. I was not asked to initial this provision when I signed the contract, so how would a person know if this applied?

Since I contacted Safe Touch prior to my move and no mention was made that anything had to be returned, I assumed that all was in order when I sold the property and moved. I am not aware of any attempt made to contact me prior to the receipt of the demand letter I received in April. I am disputing the demand.

If there is anyone else out there that has dealt with this issue, I would like to hear about it.
