Ripoff, damaged our house, dishonest, fraud, lied to, cheated, mislead, stole from us

It has been almost 2 years now since we were ripped off by Clayton Homes. We bought a $100.000 modular home from them Dec. 2003.

It was deleiverd 3, It was almost 2 weeks before they set our home after delivery. We was told that the crane would be at the site the next day.
The Manger that we bought the home from kept empasizeing the fact that we had to pay for the home as soon as it was deleivered to our site.
So we paid him upon deleivery. Big mistake. Never pay untill all the work is finished.

During the set up of our home it was dropped and damaged. We didnt get in touch with the manger that day to talk to him but the crane man did and asured us that it would all be fixed back like it was before it was dropped.

I would also like to say that during the setup their was piles of trashs and nails that was left behind that we had to pick up and haul off. When we mentioned it to the setup crew they just said that the finishing (contractor) was suppose to do that. Though he didnt.

We took it in good faith that they would do all that they promised. The house was in terrible shape when the setup crew left. They didnt even put the rafters in the attic. They were left laying in the living room floor and no one knew what they were for.

When the finishing contractor came one man (If you could call him that) He would only work for a hour or two everytime that he came spending most of his time on his cell phone. And making excuses that he had to leave.

Example: Once he had to leave because his dog got ran over and he had to take it to the Vet. Then once he didnt come because he got sunburned. Just one excuse after another.
We was told when we bought our house that we would be in it in 2 to 3 weeks.

But of course being a Modular we thought maybe a month or two, we had no idea that it would be 7 months.

After the contractor, s last excuse it was 2 weeks and he hadnt returned to do anymore work so we got a lawyer.
This was in May.

Our lawyer told us that we shouldve made them take the house back as soon as they dropped it. But we didnt know that we could, we thought that since we had already paid for it we was stuck with it. Our lawyer also told us that we needed to give them ampule enough time to fix it.

So we did, they had some men from the company come in and work on it, only it they did fix all that needed to be fixed and when they told us that they were done there was trash everywhere that we had to clean up. It still wouldnt pass the state building codes, so that we could get moved in.

It states on Claytons website that they site build homes to state building codes. Their was so many things that stll needed fixed, our lawyer even said that she couldnt tell diference in it.

The men from the factory said that they were done so our lawyer told us to give Clayton a little longer to see if they were planning to come back and fix anything else. All the plumbing leaked, the roof leaked, their was no light at the stairways, no handrails, the doors didnt open and closed properly.
I can go on and on.

We gave them until Sept. 2004 and our lawyer told us that it would be to our best interest if we fixed these things ourselves so that we could get moved in.

In the meantime we have paid out $7000.in interest where we borrowed the money and its on a construction loan.

We finally get to move in on Nov. 6th. Our lawyer told us to keep records of all the work that we had done that we would be remberced for it.

Our law firm filed for a petion to arbritate in Nov. 2004.
Clayton Homes lawyer in every way that he could made it impossible to arbritrate.

Claytons lawyer said that we must go strictly by the contract that we signed. I would also like to state that we was pressed into and rushed through it.

We didnt even know what arbritation was. It was almost impossible for our lawyer to find out about it. If a lawyer has that much trouble with arbrition they have to know that their is no way that a consumer can set it up. And Clayton Homes wouldnt help us in any way to find out about arbrition.

Well our lawyer did go strictly by the contract only to find out that the AAA American Arbritation Assoctation will not deal will Clayton Homes at all.

It has bee since May when we got the letter from the AAA telling us that they dont want to deal with CMH.

Then our lawyer told us that she was going to file a motion to have judgement in court. It has been since June that we last heard from her. I called her office many time and didnt get any return calls.

I found out from a court website that she didnt file the motion for judgement until Aug. 18. And when I talked to her today she said that the Judge was new and that she would just argue to arbritate.

I am so fed up with this whole mess and I just dont want any other buyers to have the same horrible ordeal happen to them.
We need help! We need to stop Clayton Homes and other manufactors from doing this again. Help us to seek some peace from this nightmare.
