Whataburger complaints: where a problem can be taken
Checked on 2026-10-18. Whataburger's own website, whataburger.com, answered our automated fetchers with an HTTP 406 error that day, so we could not read its contact, terms, privacy or refund pages and do not quote them here. Its careers site (careers.whataburger.com) did load, but it covers jobs only. For a company phone number, app or online-order help, and the rules for refunds or order problems, use the contact page on whataburger.com or the receipt for the restaurant you visited. We list no company phone as verified.
- BBB. BBB's profile for Whataburger in San Antonio accepts complaints and lists (210) 476-6000. That number is shown in the header of BBB's profile; BBB's Phone Numbers block also lists many other numbers, mostly restaurant lines, and does not label any as headquarters. It does not come from a Whataburger page (read 2026-10-18).
- Texas Attorney General. The office's consumer-complaint page says complaints are open to the public under Texas law and that the office cannot give legal advice. Attorneys general in other states take complaints about restaurants located there.
- Food illness or a foreign object. The FDA's page for reporting problems says to direct concerns to the right FDA center through its SmartHub page, or to call 1-888-INFO-FDA. Local health departments inspect restaurants and take reports of suspected food poisoning. Keep the receipt, any packaging and photos.
- Payment problems. A charge for food you did not receive can be disputed with your card issuer; keep the receipt and a note of the time and restaurant number.
Who operates Whataburger
BBB lists Whataburger, a limited liability company, with headquarters at 300 Concord Plaza Dr, San Antonio, TX 78216-6903, and gives 'Whataburger Restaurants, LLC' as an alternate name. BBB's raw page data shows a business start of 1978-05-01 and an incorporation date of 2006-09-11 (read 2026-10-18); BBB's start date is its own record and is not a statement about when the chain was founded. The EEOC's 2020 press release names the defendant in its lawsuit as 'Whataburger Restaurants LLC'.
The careers site shows the copyright line 'Whataburger, Inc.' (2023). Restaurant Business reported in September 2024 that BDT Capital Partners, a Chicago-based investment firm, acquired a majority stake in Whataburger in 2019, and that the chain had been family-owned for 69 years by the Dobson family before that. That is the trade publication's account; we could not read Whataburger's own pages to confirm the current ownership, and the BBB profile's listed president is not used here as a statement of who currently leads the company. Franchised and company-operated restaurants may be run by different legal entities, so a particular store's operator can differ from the headquarters entity.
Complaint record: BBB, Trustpilot and this site's archive
BBB (the headquarters file for Whataburger, San Antonio, TX), as displayed on 2026-10-18: not BBB accredited; BBB Rating D-, with the stated reason 'Failure to respond to 74 complaint(s) filed against business'; '117 total complaints in the last 3 years' and '28 complaints filed in the last 12 months'; customer reviews '1.56/5 stars, Average of 33 Customer Reviews'. BBB lists many other location files for Whataburger Restaurants whose figures we did not combine.
Trustpilot, as displayed on 2026-10-18: 2.6 from 176 reviews; unclaimed profile; Trustpilot states it does not fact-check reviews. Its AI-generated summary of recent reviews mentions cold or tasteless food, missing or wrong items and slow service. The platform figures are shown separately and are not added to each other or to this site's count.
This site's archive. 35 approved posts from 2006 to 2013 name Whataburger as the subject. They are mixed: 21 describe a problem and 14 are favorable accounts that praise a restaurant, an employee or the food, which this page does not count as complaints. The problems described are individual accounts of staff conduct, wrong or missing items, long drive-thru waits, cleanliness or food-safety concerns, and one employee's account, written while still employed in 2009, of working conditions. They are unverified consumer statements, and all are more than ten years old; they say nothing about how any restaurant operates today.
Court filings and government action
EEOC consent decree. The U.S. Equal Employment Opportunity Commission announced on 2020-04-27 that Whataburger Restaurants LLC agreed to pay $180,000 and furnish other relief to settle a retaliatory harassment and constructive discharge lawsuit the EEOC filed in the U.S. District Court for the Northern District of Florida, Tallahassee Division (EEOC v. Whataburger Restaurants LLC, Case No. 4:17-cv-00428-WS-MAF). According to the EEOC's lawsuit, a general manager of a Tallahassee Whataburger location instructed her hiring manager to hire white, not black, applicants, and the hiring manager who complained was then subjected to abuse and a schedule change that forced her to resign; the EEOC says the alleged conduct violates Title VII of the Civil Rights Act of 1964. The release says the three-year consent decree requires Whataburger to adopt new human resources policies, conduct training, maintain an anonymous hotline for complaints, post a notice and report new retaliation complaints to the EEOC. These are the EEOC's allegations as stated in its release; the release does not describe the company's own position.
Employee-benefits class action. The San Antonio Express-News reported on 2026-06-18 (via Yahoo Finance) that a former employee filed a proposed class action in federal court in San Antonio against Whataburger Restaurants LLC and its employee benefit plan, alleging that tobacco-use health-plan surcharges violated the federal Employee Retirement Income Security Act (ERISA). The article says a company spokesperson declined to comment and that no answer had been filed. We did not open the docket, so we give no docket number or later status.
Arbitration ruling. Law360 reported on 2026-10-16, in a headline and summary visible without a subscription, that a Texas appellate court declined to send a former Whataburger employee's lawsuit to arbitration, finding that the allegations of unwanted sexual touching trigger a federal law that bars arbitration of such claims. We could not read the full article or the opinion, and the underlying case is an allegation that remains in litigation.
A CourtListener search for other federal dockets naming Whataburger entities could not be completed on 2026-10-18 (its search returned a rate-limit or human-verification response), so this page does not count or describe other dockets. We did not identify a consumer class action in the sources checked on 2026-10-18; this is a limited search, not a finding that none exists. Filing a lawsuit is an allegation, not a finding.
Is Whataburger Legitimate?
BBB lists Whataburger as a limited liability company headquartered at 300 Concord Plaza Dr, San Antonio, Texas, and its careers site carries the Whataburger, Inc. name; the EEOC's 2020 release names Whataburger Restaurants LLC as the defendant in its lawsuit.
BBB shows the business as not accredited with a D- rating, 117 complaints in three years and a note about unanswered complaints, as displayed on 2026-10-18. Complaints and reviews on BBB, Trustpilot and this site are consumers' statements about individual visits. Experience varies by restaurant, and the figures do not measure how the chain treats the typical customer.
