I worked at Golden State overnight delivery company in Reno, Nv for six years from 05 to 07.in feb I paid the regional manager Mr. David Smith $4396.33 towards the purchase of 2001 Nissan x-terra se-3.3l with approximately 107000 mile on it which was registered in his name but was owned by another person. The purchase price was $ 6000. Mr. Smith did'nt have the title for the car or it was misplaced or lost as he told me after I had already paid him, but he promised to get it within a couple weeks which never happened and then he told me there was a problem with the title and offered me to sell his other car the one he was driving which was a Kia Sorento 2007 that had around 150,000 miles on it for the same price as the nissan which was $ 6000. He also said the Kia was paid off and he had the title for it. After that I paid him another $ 825 to be applied towards the purchase so the total amount I paid him is 5221.33. He never gave me the car as he was still in the process of buying a new car for himself. On April 29th which was a sunday he calls and leaves a voicemail on my phone @7am while I am still asleep saying that now he wants $10000 for the car instead of $6000 and that if this is not acceptable to me he will refund all my money and brags about how he can sell his car right away for $10000. I still have that voicemail saved to my phone which is loud and clear. So I check KBB on the car and it's worth around $ 8400. On 4/30 I go talk to him at the office and he says he's firm on the price which is $10000. So I tell him I can't afford it that price and would like to have my money back. He totally freaks out on me saying that why I decided to buy the car if I could'nt afford it and he does'nt carry $5225 in his backpocket to pay me back and he spent it on another car. I am shocked so I ask him how long will it take to get my money back and he says about a month so I agreed and today is 11/01 and I still have'nt got my money back. Since I was an employee at golden state at that point and he is the manager he started harassing me. When I talked to my supervisor about this who's sister owned the Nissan x-terra he said his sister has'nt received the money either. We discussed about legal options and filing a complaint with the company but for some reason the supervisor decided to tell Mr. Smith about it and Mr smith retaliated against me. He told me to keep my mouth shut or I was going to get fired. His harassment continued including denying me a annual review or raise and threatening me with my job when I asked for my money. Finally due to harassment and mental distress I quit my job in 07/12 even at that point he promised to return my money the day I quit but never did. So I tried to pursue this matter thru my attorney and recently 0n 10/29 Mr Smith followed me in his company van at my new job and threatened me with physical harm after which I filed a police complaint and got a restraining order against him.
