Insurance company ripoff who refuse to payoff claim once recovered totaled out vehicle

My Complaint is no one will return my calls and I have no ideal where my car is located. Vehicle has not been paid off as it is accruing charges on interest rate. The power of attorney for transfer of ownership has not been signed.

1. On September 17th of my 2000 Nissan Altima GXE was hit by Ms. Castillo after she ran a red light on NW 19th and Dalworth approximately at 8:08 AM. My 16 year old daughter was driving my car with a licensed adult age 45 along with my 4 year old son who has been traumatized ever since. The police report # 030031311 state Ms. Castillo failed to see red-light due to morning sun rise. Once a call was placed to Ms. Patti Koman,
she insisted that I find witnesses other than the passengers in my vehicle before they agree to pay for rental due to their client changed her story. I found witness and provided the
information needed. I had problems with Ms. Koman returning my calls at first so I had to contact her supervisor, Elaine Edwards.

2. I called Elaine Edwards and informed her that I was having problem with receiving
assistance in getting a rental car. Friday the 19th around 2:15 PM, I was given the approval. I was told to give the approval for Don Davis Auto Group to pick up my car to cancel the city pound storage fee. I was told that an adjuster would go out to do the estimate and I would be notified if totaled. On Wednesday the 24th, I was told that it was considered totaled. Patti made an offer but would have to check into the fact about new tires on the car which I asked for reimbursement. I spent 326.11 and she offered $234 for tires. I asked for more on pay-off due to my car had low mileage (40,074) and excellent condition. At the time, Ms. Koman offered $9,974.53. She tried to explain but I request to see it in written form so I could look over it and comprehend. I waited but no return call again and nothing in the mail.

3. I had to call Ms. Edwards again for pay-off quote due to Ms. Koman did not return my calls nor mail me anything in writing. I even faxed over papers and request confirmation. Finally on Friday the 26th of September, I was told that the offer would be $10,147.18. Ms. Koman stated that she would have to ask about the $250 reimbursement for the deductible I had just paid to replace the front bumper August 27th. Again, I asked that the
new offer be written in a letter and presented to me for agreement. I knew I would need something to go by for the substitution of collateral deal with my finance company. I did
however receive a letter form for release of title but nothing else. I waited for a return phone call again.

4. I had to call Ms. Edwards again on Monday the 29th to find out what was the pay-off offer now since I have been trying to negotiate the offer. Due to the fact that I had a car with pay-off of 16,203.48, I was waiting patiently. Ms. Koman finally called back and said they would pay no more for the car and my time was running out on the rental. I explained that I have 2 children I have to take back and forward to school and I had no other way so I could not return it and especially without anything in writing. I told her it was unprofessional for me to go by hear say... Everything need to be in black and white. She
explained that this was normal procedure and I should call my insurance company and file a claim for the remaining balance due since I also have coverage. That was the last time I had heard from her. I even made sure I called her supervisor to help with receiving the proper information in writing but I did not hear back from Ms. Edwards. I even left message on Ms. Edwards voice mail that I was keeping the rental until written notice is
provided.

5. I filed a claim on Monday the 29th through Farmers Insurance (my insurance company) thinking that they would work with Rodney D. Young and resolve the issues. I had no ideal of what to do next. I waited for the call back but in Farmers system, they were told that Rodney D. Young was taking care of everything. They closed their files. I knew that even if I went through my insurance, I have a $250 deductible but I may have a better
chance in recovery. I knew I would have up to 30 days on the rental too. On Wednesday of October the 15th, I spoke with Ms. Patricia Bird from my Farmers Insurance company (817-467-7671). She finally explain in more detail how they figure out the offers on totaled cars. She has no problem with sending me any information in writing. I thought by law it was a sure thing to do if claimant ask for written statement. During this time, there
was no paperwork sent nor any telephone calls from Ms. Koman nor Ms. Edwards.

6. Ms. Bird offered to help me resolve this problem. I knew my time was running out. During this time, I had been working on finding me another vehicle. I was told by one dealership that they were told by the finance company (Americredit) were not doing the substitution of collateral. I then started looking for a cash car. I found one but it need work done to it. Ms. Bird from Farmers told me that it has been 27 days so I need to hurry
up before the time run out. We called to speak to Ms. Koman at Rodney D. Young on Wednesday the 15th. Ms. Koman stated that I had never asked for anything in writing. She also stated that she told me to return the rental weeks earlier so I would be
responsible for 17 days. Ms. Bird explained to her that since she did not make it clear nor sent the paperwork to me, I still had the rental. Ms. Bird from Farmers told her that she would have me to return the rental if she would fax over papers explaining how she came up with the figure for pay-off. Ms. Koman faxed over a page from her company so I return the vehicle to Enterprise by 5 PM.

7. Now that paperwork that was faxed over to Ms. Bird at Farmers was inconclusive. She explained that she just received a paper from the NADA program of Ms. Koman but could not find the $10,450 amount. There was no note attached with any explanation of the retail value and how they ended up with the $10,147.18 total. She tried to explain that from Farmers end, the amount would have been $10,604.88 with tax, title, and license.
When this was explained to Ms. Koman, she said that they figure it another way but presented nothing in writing.

What do you consider to be a fair resolution to your problem?:

1. I believe that Rodney D. Young should pay for the total amount but that's wishful thinking. They should offer the NADA amount of the $10,450 they found my car to be valued at on their computer program, along with tax, title, and license. Plus they
should add additional credit for the low mileage and condition. I wish it could be more but I understand now. I will have to rollover the negative balance from $16,301.41 as of 10/18/03.in all fairness, their client hit my car and now I have nothing but another bill and nothing to show for it.

2. Rodney D. Young should reimburse me for the $250 which I had just spent on August the 27th replacing the front bumper from scraps and scratches. I had to file a claim with Farmers because I had bumped into someone's tow bar. I replace the bumper only. The $250 is my deductible I spent.

3. I should be reimbursed more for the tires due to the fact I had purchased the road hazard warranty and never used it on 4 tires. So it should be at least $290.00 when I had paid $326.11 at the end of July of this year. I should not owe anything else for the car rental due to the fact that once they faxed over paperwork to Farmers, I released the vehicle as I had promised.

4. I should not be responsible of any other charges such as rental. Please help me resolve this issue. I am a handicap and disabled woman with 3 children on a fixed income. I can not afford to go without a vehicle nor buy a new one. I wish I could have had my own car fixed which has my handicap plates on it. I do believe that explaining everything in black and white would have helped in resolving most of the problem. I am faced with car rental I may have to pay for if they reject the 17 days. I believe I kept my end of the agreement as far as returning the car once paper work was sent to Farmers. With Farmers Insurance, I have up to 30 days and I only kept the rental for 27.

5. I feel that I should receive a personal letter breaking down all transaction of this case (648486) from Rodney D. Young. I know it may be stretching it but I deserve an apology from Ms Koman for hanging up the telephone twice on me even when I have been professional to her. Per our last conversation, she stated that she had been recording our conversations. I said great because it would back my claim of requesting everything in
writing due to the fact that I would consider that being the professional way of doing things. I asked if she had also saved the voicemails to go with the other recordings. She said they were deleted. She then transferred me to Ms. Edward's voicemail without asking if I wanted to speak to her supervisor. She did not indicate that our telephone conversation was even over. So once again, I asked Ms. Edwards to please give me a call at home. That time was a little before 1PM so I thought I would get a call back after lunch. I have received no telephone call nor paperwork as of today.
