Acura Corporation Fail And Neglected To Repair Our Vehicle While It Was Under Warranty

We are filing a Lawsuit against all Defendants we dealt with!!! This is the demand they were sent. Damon said by phone, they are not going to anything for us!!! We will see all of them in Court!!! To Whom It May Concern,

This communication is in reference to the above case andvehicle.

Any information can be obtained from the Case Manager, knownonly to me as Damon.

Damon stated to me that he was noting everything Idiscussed with him by phone during the past week. I will not spend anymoretime in regard to this matter. I have spent to many hours, since the defect toour vehicle was first reported.

I explained to Damon that we are willing to spent $2000.00to repair, what have been told is needed. We have received a written diagnosisfor a complete Clutch Assembly. We paid approximately$225.00 for two Acura Dealers to diagnosis the RSX.
I have stated our position in regard to what we arerequesting from Acura Corporation.

Our RSX had, before, during and after the new transmissionwas put in, a grinding, shifting and popping out of gear problems. This defectis well documented, by written, verbal and cell phone records, of conversationsbetween me, and many individuals that are including, but not limited to, beingdirectly or indirectly connected to Acura Corporation, their agent and oragents. Some of the individuals are including but not limited to, the firstCase Manager that handled our complaint, Shawn Manning, the Service Manager atMorande Acura. Most recently the Service Writer Steve Kuchman & Service ManagerJoseph Fazzina, of Morande Acura, and Damon of Client Services with Acura.
According to research I have done, there are many peoplethat have experienced

The exact problems we have. There are also 2 separateTechnical Service Bulletins listed on the NHTSA Website, stating the exactdefect we have complained about.
They are grinding, shifting and popping out of gear problems.

I was told by Damon that Acuras position is that they willnot give us any guarantee
of any repair to the transmission, until it is removed anddisassembled at our expense.

I find that very disturbing, because of the fact, that ourvehicle continued to have grinding, shifting and popping out of gear problems, as I state previously. The fact that our vehicle has approximately 98,000miles, has no bearing. This is a known defect and has been, and continues to bethere. According to information given to me by an Acura individual, Clutchproblems have been the main cause of shifting and grinding problems with RSX vehicles. It appears, we may have had a defective Clutch, not Transmission when it wasreplaced.

If a resolution to the defect of our vehicle is not reachedon or before May 20

We will pursue a legal remedy, Forthwith.in additionwe will file formal complaints with all agencies that oversee Motor VehiclesComplaints in Connecticut, including but notlimited to the State Of Connecticut Department Of Consumer Protection, State Of Connecticut Department Of Motor Vehicles, State Of Connecticut Attorney General and The Better Business Bureau (Auto).

Based on the foregoing information, it is our belief, Acuraand its Agent and or Agents
failed and neglected to correct the known defect to ourvehicle. A direct violation of the,
