Donald Webb has had several lawsuits filed against him over his alleged fraudulent activities involving cars. I suspect I am not the only one he has bilked. If anyone else has had a similar experience with him, please contact me. I am trying to get the Phoenix Police Department to open an investigation into his activities.
The following is taken from an affadavit I filed with Phoenix Police against Donald Webb and Arizona Desert Enterprises:
My 17-year-old son bought a 1994 Nissan Altima from Donald Webb for $3,500 cash. When we purchased the car, it was registered to Arizona Desert Enterprises. Mr. Webb told us the car had only a minor oil leak, needed new tires and had 89,000 miles on it.
After paying for the vehicle, I learned that not only did it have more than 89,000 miles on it but that it also had no brakes, and the oil leak was a major problem that would cost almost $1,000 to repair. Mr. Webb also told me the car had never been in an accident although my mechanic claims there is evidence it had, including a bent rear wheel. It also had other problems which my mechanic said Mr. Webb had to be fully aware of before he sold us the vehicle.
When I called Mr. Webb to tell him he had been deceptive about both the cars condition and its mileage, he agreed to fix the vehicle for $489. According to an agreement written by Mr. Webb, I would pay him the $489 upon completion of the work and after it was inspected at an independent garage
Mr. Webb kept the car for more than two weeks on the pretense of making the repairs. During that time, I had difficulty contacting him and he did not return my calls. When I finally went to pick up the car on July 5, Mr. Webb refused to release it to me to have it inspected and would not agree to bring the car to be inspected unless he was paid first, even though we had a written agreement stating that he would be paid once the car was inspected by an independent garage. I gave him $200 cash with the understanding that he would receive the remaining $289 after he brought the car to a garage for inspection. Mr. Webb did not show up at the agreed upon garage to have the car inspected and has refused to release the car to me.
When I again went to retrieve the car on July 7, Mr. Webb informed me that he had placed the car in storage. He would not tell me where the car was and refused to retrieve the vehicle for me. He has told police he has a mechanic's lien against the vehicle even though no mechanic's lien has been filed. He remains in possession of both the car and my license plates and has refused to return either, despite my repeated attempts to pay him.
It should be noted that Mr. Webb has at least one civil case in Maricopa County Court charging him with fraud in connection with another vehicle scam (Civil case CV06821) and, according to court records, is involved in what appear to be several shady business deals, all involving cars.
As for the Altima we purchased from Mr. Webb, it was bought by my son, an honors student with a straight A average, who has worked hard and saved up for years to buy his own vehicle. Like any teenager, he was very excited about owning his first car. To have something like this happen has been devastating for him. He has continued to make the insurance payments on the car even though it is still in Mr. Webbs possession.in addition to taking my sons life-savings, Mr. Webb is now in posession of a vehicle without my authorization that my son has paid to insure.
Despite my attempts to get the police to look into the matter, they have taken no action. They consider this a "civil matter" even though they have taken an auto theft report on it.
