On 11/21 I decided to cancel my order and request a full refund. I sent a registered letter to the General Sales Manager. The General Sales Manager called me on 11/28 about the cancellation letter. He indicated that he could not cancel the order or refund my deposit. I told him I no longer want the vehicle, that they did not meet the 6 - 10 week delivery date, no scheduled date to build the vehicle; no VIN assigned and demanded my money back. He has refused to do so. I have consulted my Attorney and he will be perusing my deposit recovery.
To this day (02/09/09) I have not heard from anyone from Port City Chrysler Dodge since 11/28 when I spoke to the General Sales Manager regarding my cancellation letter and request for a refund. Please note that this vehicle was ordered on 9/27.
I have contacted the BBB and filed a complaint against them and my credit card company as well. My credit card company did refund my money however, since the 6 - 10 week delivery period was not noted on the purchase agreement; they had to give the money back to Port City Chrysler Dodge. I have a witness that who was with me at the time to vouch for the 6 - 10 week delivery. However, that's just hearsay.
According to Chrysler, the vehicle was built on 01/19 and was received by Port City Chrysler Dodge on 02/02. That's a total of 20 weeks to wait for a car. That's totally unacceptable! I confirmed this when I spoke to Chrysler Customer Service on February 4.
So now they can sell the car and attempt to keep my deposit. I feel that this is a very poor business practice where the consumer looses in the end. Hopefully one of them will read this, have a conscience and put themselves in my shoes; maybe even have the decency to refund my deposit. I'm sure if it was any of them they would want their full deposit back.
I guess in the end, if anyone plans to order a new vehicle, make sure you get the delivery date in writting.
