I was hired by Western Flyer Express around May 25th. I filled out their application, I did the interview there at Western Flyer Express. I did how ever get my pay checks from TLC (Transport Leasing Services).
I had done several loads for this company already, down into Texas, and one over to the carolinas. I got dispatched out on May 2nd, back to the carolinas. I went home to rest befor leaving out, and was told no spacific route to take.
Leaving Ardmore, Oklahoma, I cut across to Hwy 69 No. I got up just north of Atoka, Oklahoma, and I noticed black smoke coming from my vents.By the time I got it to the shoulder of the road, the motor was engulfed in flames, and the cab was filled with black smoke; I barely got out with my life and my pup. I lost everything I owned!
I attempted to call the company, and the answering service told me they would call the dispatcher on duty (Mike), and inform him of my cituation, but I never recieved a phone call back.
I called for a 3rd time, using the Hwy Patrolman's phone, and they didn't want to hear me, so I handed the phone to the Officer, and the answering service hung up on the Officer as he was trying to explain the severity of my cituation.
I spent the night in a motel, (at the generosity of the Officers), and the next day, I spent from around 11:15am to after 6pm on the 3rd, finding a way home.
At around 4:10 in the afternoon, the safety man calls me, (@ the County Sherriff's Office), to tell me"oh, by the way, you HAD 32 hrs from the time of your truck melt down to get to the clinic in Oklahoma City for a drug test".
I told him I had no way to get there and he replied"not my problem". I finally got a ride back home to Ardmore; my sister-in-law came for me.
On the morning of the 4th, I called the office to find out what was going on, and was told "I was fired for refusal of a drug test", (I never refused!).
I later called the safety man and asked what was I really terminated for and he said"refusal of the drug test, unauthorized use of a vehicle, and out of route! Please, can someone tell me how can this be, when I was under a load, was given NO spacific route to take, and was abanded by the company and had no way to GET to the drug test.
You see, the way I look at it, if they REALLY wanted me to take that drug test, I could have taken it at any time, sitting there all day at the County Sherriff's Office. They used me as a scape goat for insurance purposes or something, because they knew that truck was going down.
And, to top it off, they charged 500.00 for my pup to ride with me. I accepted it, but I was only with them for 9 days. My one and only pay check was for over $900.00, and I only got a little over $354.00 of it. How can this be fair?!
