Of Milwaukie 4500 Tradei n negated, forced to pay $1600 more Milwaukie

1. On June 23, Premier Hyundai sold us a 2007 Elantra with 2700 miles for $16,500. We put down $2,000 cash and were given $2500 trade-in on our 2003 Hyundai. After the sale was completed, we discovered the car did not have air conditioning. The salesman promised to have air installed in the car. We paid Premier Hyundai an additional $500 to install air in the car.

2. For two months they claimed that parts had not arrived. During that time, we spent $1140 to have the car fitted with base plates and wiring so we could tow it behind our motorhome. On August 25,2 months after purchase, they told us to bring in the car for installation of air. Two days later, the service manager called and said they could not put air in this car but they would have an equivalent car for us on September 11 at 10:30 A.M.

3. When we arrived we were offered two choices: a 2007 Hyundai Elantra with air and 14,000 miles, or a stripped new 2008 Elantra with no radio, floor mats or air. They assured us that they could install air in this one and would do that free of charge if we chose the 2008. They also agreed to move our towing equipment to the car we selected, without labor charge.

Both cars carried an MSRP sticker price of $16,450 which included $2,000 for "dealer markup." We felt either one would be a satisfactory exchange and decided not to ask Premier to refund the difference between the $17,257 we originally paid and the value of $16,450 we were now being offered.

4. However, Premier Hyundai did not plan an even exchange. First, they wanted to buy back from us the car that they had sold us for $17,000 on June 23. They offered $11,100. After we expressed agmazement, they agreed to pay us $13,131 for a car they had sold us 2 months previously for $17,257. They then required $1600 cash down payment.

We had to take out a new loan with our bank, and over the months from June 23 to September 11, our bank's interest rate had increased from 5.3 to 5.6%, and therefore so did our monthly payments. Also, we had paid $550) to license the original car and had to pay $550 again to license the replacement vehicle.

6. Since they wanted us to pay additional money for the we asked to discuss buying the 2007 instead, and they would not sell it to us. They would give us no numbers or price on this car, simply repeated that the numbers would not work. Apparently they never intended to let us have it.

7..in the end they told us, "Accept this deal, or drive away in your original 2007 Elantra." We knew that car could never have air conditioning installed, so very reluctantly we wrote them a check for $1600.

In the following week, they did live up to their contract to put air conditioning in the new car and to transfer the towing equipment without charge. However, they bungled that job and later we had to pay $500 to have the towing equipment properly installed. They had put in one part backwards.

8. We believe they cheated us through predatory sales tactics. The method they used was devaluing the 2007 Elantra from $17,257 to $ 13,131.

9. The attorney general of Oregon denied our complaint on the grounds that we had signed the papers thereby entering into a legal agreement.
