Dealer has refused to pay off trade-in because they want more money - 30 days has past

To Whom It May Concern,
I recently purchased a 2006 Cadillac STS from West Coast Auto Sales, in Montclair, CA.
Here is what occurred from start to finish.

I had listed my 1997 Jaguar XK8 on Cars.com for $15,500. The same week I listed my car I saw the Cadillac on the same web site but I noticed it was about an hour away. So I called and told him I would like to buy the vehicle if we worked out a deal on the phone I would come out there and complete the transaction. I had him go look at my Jaguar on Cars.com and he ran it through Kelly Blue book said it was only worth $11,000.

Then he ran it through an action and said he could only give me $9,000. I said I owed 15,000 on my Jag and he said there is plenty of equity on the Cadillac to put the $6,000 onto of the price. So I asked him if the rims on his vehicle will cost extra and he said they are already on the vehicle so he could give them to me for about $1000 and it is no big deal just come down he will hook me up.

So I said lets go back over the numbers $19,888 for your Cadillac, $9,000 for my Jaguar putting the extra $6,000 for the payoff on the Cadillac and $1,000 for the rims making the grand total $26,888. If this is the deal I will be out there tonight. He said, YES. So I went out there got to the table to do the paperwork and he said we are only going to give you $7,500 for your Jaguar they are real low in value right now.

So I looked at the contract and noticed he only charged me $500 for the rims, which was put under accessories. So I figured he was shorting me $1,500 on my Jaguar from the deal that we made on the phone but only charging me $500 instead of $1,000 for the rims so I was losing $1,000 from the deal on the phone which didnt make me happy and I should of paid attention to that as the first red flag that this guy is not on the up and up. The fact of the matter was I drove all the way out there and the paper work was right in front of me so I decided just to do it. So the deal was done on April 7.

On April 9th I received a call from some guy saying he was the GM at the car dealership and asking how I wanted to pay for the rims of $2,500. I said I already paid and it is in my contract. I pointed out the $500 for accessories in the contract and he said no that is for something else and I said what else it could be nothing else was discussed.

He put Bessem on the phone which is the Finance manager I first made the phone deal with and did they paper work and he said he the $500 was a mistake for the window tint and it should not be on there. I also tried to discuss with them if they felt that is was unfair I could give the car back and they agreed but said they would charge me money for having there car and $ for my trade in.

So I said why would I pay them I do not have the problem with the deal they do and they said that is the way it is and I was not about to pay them a couple thousand dollars just because they said that I owed them for it when that was not the deal we agreed upon, nor was it in the contract I had signed.

So after a bunch of discussions they said they had the first conversation recorded on some special phone recording system they have that records all there calls and that it shows I was incorrect that they never said they would give me the rims for that price and the could send me a copy so just send them $1,750 for the rims and tires.

I said send me a copy of the tape recorded conversation that you have and we can see who is right and who is wrong to try and resolve this matter. Then he said no I am not going to send you a copy of it (which was their idea in the first place) but you will send me a my money you do not want to mess with me I am a multimillionaire with 10 attorney and I will make you spend 10 times the cost of the rims in court fees if you mess with me and that money was nothing to him. Just send me the money or we will not pay off your Jaguar.

At this time I felt as if they where not only telling me lie after lie but trying to extort money out of me. The next thing I saw was my Jaguar on Cars.com for $13,888 and also listed on their web site but they still have not paid the car off as it was agreed upon in the contract. It has almost been a month and my first payment is due on the new car and I will also have to pay one on my old car to stop it from having a late payment. I feel that they have been trying to bully me and extort $ out of me.
