Over two years ago I was in what is considered a low-impact automobile accident. The trooper cited the driver who hit me for going to fast for road conditions. I was not cited because I was sitting at a red light. Unfortunately, I had my head turned to the right and did not anticipate the accident. I was hit in my little red Mazda protege5 by a 2500 pick up truck with a snow machine trailer and snow machines in tow. It caused a compression injury that now perpetuates constant pain. On a scale of 0 to 10 I am usually at a 6. I have had nerves burned off with great relief until the nerves grow back. I am now undergoing implantation of a spinal cord stimulator because the trial was fantastic and gave me great relief.
Progressive Insurance has only paid to have the car fixed and has not paid a cent of the medical bills, which are now about $35000 and rising. They have never asked for a medical examine even though we have offered. My attorney says it is the game they play, holding out and taking the risk that I will just go away. I never thought in a no-fault accident that an insurance company could actually refuse to pay what the insured driver has given money for them to pay. They have nothing to lose. If it were not for my husband's company insurance paying for everything until it is settled, I would have had to fold because I could not have paid the bills. The insurance company says they do not believe I could have endured this injury from the accident even though they have received all of my medical records and I have never had a neck injury or problems in the past. They are playing on the "people sue all the time" mentality that they have created. I just want them to do an examination and tell me that I have not received this injury from the accident. Because as my doctor, Dr. Cross of Advanced Medical Centers of Alaska states, I did receive this injury from the accident AND it is absolutely possible to have done so.
Can you help at least to start the discussion as to why they have not even bothered to examine me to see if I am in fact a fraud out to make a bunch of money? The amazing thing is that I can only receive $50,000 to cover all the medical bills, attorney, and lost wages because the insured that hit me only has a $50,000 policy. How exactly is it worth the time and energy for me to get what's left after bills and attorney. I make $150/hour as a trainer and CEO of my own one-person business management company. It is not worth the amount of time I spend at the doctor, filling out forms, and speaking with an attorney to make $10,000 which would only cover lost wages and a few minutes of the pain that I will live with for the rest of my life.
This amount of pain makes a person agitated and depressed. As a 39-year-old woman with a masters degree, a husband of 15 years, and three beautiful children, this is very hard to have this kind of pain every minute of every day unless I take heavy pain medicine which creates a very tired and less productive person.
