To whom it may concern

On august 31 I (Randy B) purchased a new motor scooter out of a magazine advertisement - Walnecks classic cycle trader distributed by trader publications.in the ad of ExtremeScooters located at 103 arthur ct. Warner Robins. Ga it clearly states that the scooter will go 65mph, that it has a "YAMAHA" 125cc engine, blue or silver, total price and that included delivery to my residence.

I had also seen the ad on the internet extremescooter.com on august 28. I called the next day and talked to the owner Dave Bergman about the Daytona 125. I told him that I would be driving it on Texas 46 and US 281 to and from work and asked him if he had a bike that would go faster than 65 mph. He said yes, I have a 250cc Yamaha that will go 85mph and that he would let me have it for the same price.

I said great and placed an order with him for a blue 250cc Daytona with a yamaha engine. He told me to overnight a cashier's check payable to him (Dave Bergman) not the company name to P.O. Box 6497 Warner Robins. Ga not the company address and to be sure to indicate blue 250cc on the check and expect delivery in 3 to 5 days. Before we ended the call I asked him if their was any assembly required and he said only the mirrows and air in front tire.

Twenty days went by with no delivery of the scooter. I called Extreme Scootes and asked Dave if scooter was on its way. He gave me the number to Mikes cycle world in Kentucky 479 967-4221, they had it and to call them. I called and they didn't know who or what I was talking about. Three days went by and still no scooter, so I called Dave back at Extreme Scooters. He said try calling R-N-L Watkins Trucking at 487 788-6424 in Macon Ga., that he sent it thur them.

I called and they said that he (Dave Bergman) has'nt used them in a while. I waited a few more days and still no delivery, so I called Dave back and found that he was screening calls and would'nt return my calls. Finally I get a call from a distributor in Houston Texas located at 5601 Bonhomme #B and the gentleman told me he had my scooter. And that he would deliver it for $200.00. I got his address and told him the delivery to my address was included in the $1699.00 that I had already paid and that I would pick it up the next day.

So the next day October 3 my wife and I drove to Houston to pick up the scooter. When we arrived at the distributor we were treated very rudely by the owner (bald guy with green eyes). He still wanted to charge me $200.00 for delivery. I showed him the ad and again told him I had already paid shipping. He then said he could charge me the same for strorage. I told him I never agreeded to anything like that, that maybe I should be reimbursed for delivery.

He and his employee took us around the corner to his warehouse where they had cycles stacked to the ceiling about 1000 units. They were all packed in large boxes, so after loading we went back to the office and I asked if the Title was in the box. The owner said no, the dealer you purchased the scooter from will send you one, Iam just the distributor (713) 784-4888.

When I got home and opened the box I noticed the cycle was Red not Blue but at the time I was willing to overlook the color because I was happy to finally have the bike and know that I didn't get totally ripped off. As I unpacked the bike I noticed right away that it had a generic 150cc Chinese made motor, not the 250cc Japanese motor I had ordered. It was like buying a BMW and getting a YUGO.

I called Dave right away to let him know I had received the wrong bike. He then told me he didnt have any 250cc left and coviced me to just test ride the bike, that I'd really like it. It needed a lot more assembly then he had lead me to believe, so he agreeded to reimburse me for an assembly charge that I had done locally. Also the blinker didnt work. Dave said he would send me the relay switch to fix the problem. He never reimbursed me or sent the relay. The bike would only go about 50 mph tops, so I called Dave back and told him I need the 250cc because this one is to slow and where is the Title?

He said I would have to break the engine slowly and the title was on the way. It became harder to contact Dave because he started screening his calls again. To this date I have'nt received a certificate or orgin title from Dave. I Tried several times to get a Texas Title in vain. A matter of fact I even tried to get Dave to send me a title less than four months ago for his $50.00 Extra fee, again something I have already paid for. Still no title. I cannot enjoy the scooter or drive it to work legally with out a title, plates, inspection, insurance, ect...

Dave Bergman has committed several crimes including but not limited to the following.

Theft by deception, mail fraud, deceptive trade practice, false advertizement, bait and switch, misleading the puplic, kickback,
false / altered documents, unreported income, organized crime

He also tries to recrute people into his ring over the phone. I bet the FCC
would like to hear about that!!!

FYI Dave has moved several times, is opening a new branch extreme hobbys, and was trying to sell the name ExtremeScooters.com., Also this letter was handed over to some nice people June 25

Lets get together and see about getting this boy and some of his buddys behind bars. I have more that I will share later.
