I am being scammed?

March I took out a lease for my brother in my name who resides in Florida I live in New Jersey. The lease was signed in New Jersey and mailed back to Orlando. My brother terminated the lease without my knowledge, consent, nor notifying me. June I get a call from Creditors Interchange at my job wanting to make payment arrangements for the balance due of 10,056.27. I advised Creditors Interchange that my brother canceled the lease and was told that no balance was due just bring in the car and give the keys back.

Carolyn Burgos said that was not the case and he had to pay the balance due or a buyout for the balance of the lease. I asked why am I being notified now and not when my brother canceled the lease so I would have at least been given the chance to refinance the term of the lease and salvage my credit? She said they thought that I lived in Florida and did not known that I lived in New Jersey. I asked could I refi with Nissan she said no they would not. She said that she would call me back and I was to let her know what I was going do to.

I was afraid of a judgement or wage garnishement. To get a monthly payment I would have to pay 10% of balance to get low monthly payments. I could not do 10% so I said take what was due which was 422 taken out of my bank account on 6/9/07. To date 400 has come out of my account since July 07. I do not have a copy of the lease nor does my brother (with whom I longer have a relationship with). I called Nissan Motor Acceptance Corp directly they said I would have to call Creditors Interchange because the documents were mailed directly to Creditors Interchange on 7/24/07 and they said that they don't know why I did not receive a copy.

Creditors Interchange said that they would mail me a copy of the lease and all the late notices sent to my brother. To date I have not received any such documents but notice of when money will be debiting my checking account and a letter stating that I agreed to pay 400 monthly (I had left a message on Carolyn's voicmail that if I am to make payments of 400 monthly I want it in writing).

The supervisor of Creditors Interchange by the name of Mr. Farentino called me to give me the information about the lease. The term was 48 months, 6.5% tax, late fee of 70.12 weekly, past due payment of 1371.17, vin# is 1N4AL11D26C194577. I will take responsibilty for whatever balance is due but 10,056.27 for a car the dealership that can sell the car and get the money back? Whenever I called Creditors Interchange a man answers but never says the name Creditors Interchange and just transfers me to my account specialist who is Carolyn Burgos.

I have called four of Nissan dealerships in Orlando. Universal Nissan & Bill Ray Nissan did not find any matches. Reed Nissan played phone tag with me Universal Nissan never called me back. My credit report reflect the lease as a voluntary surrender. I cannot get an attorney to assist me without a copy of the lease agreement. I cannot afford 400 monthly. There is no negotiating with Creditors Interchange.

I was called in July to be advised that there was a special running where I could do a settlement balance which again I could not afford. I want to make sure that I am not being railroaded into something that I shouldn't be due for. Can anyone give me advise or direction as to what I can and should do? Any assistance would be greatly appreciated.
