Columbus Georgia Abusive sales tactics and still no paperwork ripoff

Below is the original e-mail I sent that was ignored, it explains the situation

Hello,

I am contacting you via e-mail because every attempt to speak with a Sales manager, finance person or anyone in charge has met with being transferred to a voicemail no return calls. Our son purchased a Saturn Ion with us as a cosigner. The paperwork was sent via FED EX. After reviewing the paperwork it was noted that nearly half of the paperwork had no information on it. We do NOT EVER sign a blank document.

We are not happy. Our son states that Marty McCall asked him when he came back in to work the deal more You need to call Mommy and Daddy again? That is not called for. We are the ones who are co-signing on this car. James states that none of the paperwork was explained to him as he signed. He did not know he was purchasing an extended warranty. This despite our express instructions to ONLY add gap insurance. Our goal was to keep his payment down to what he can afford. Ben Alexander was given this information. When James brought back the original car he took home and I told Ben that he couldnt afford, I gave him a dollar amount. I also advised that should there not be a car in his price range we would rent him a car and purchase one for him here in Washington State.

We also explained that a long time family friend who is a retired Sales Manager for both FORD and HONDA advised us on the purchase. None of this was paid attention to. Johnny has reviewed this paperwork and cant believe what we are being asked to sign. Johnny is not just any retired Sales Manager, he was the top salesman for both Ford and Honda for years.

Our son has moved to Washington State. The car tabs expired on May 07. James was advised when he went into your dealership to get an extension on the tabs that the registration had been sent to us with the paperwork. He can not use this car in this State with expired tabs. We are obtaining legal counsel regarding the purchase of this car. Since we signed in Washington State it appears that the laws in Washington State may apply, we are still looking into this.

Your dealership has lied to us, not listened to us, insulted my son, and not returned calls. At this point we believe there are some options, send new paperwork without the extended warranty, at that point we will finance through our credit union who recently financed our Jetta for less than half the interest rate your dealership has on the papers, we could take the car to our local Chevrolet dealer and leave it there for your dealership to pick up at your expense, you may get them to purchase it from you.

The following action has or will be taken consultation with an attorney regarding this purchase, a complaint to Chevrolet, a letter to the Georgia Better Business Bureau. A complain to the Federal Government for possible violation of the truth in lending act. Heard Chevrolet currently has in various states class action law suites regarding the way your dealerships handle sales.

The State of Washington may get involved. Recently Red Ralls (a dealership in this state) a used similar tactics and was shut down by the State of Washington.

As the primary borrower on this car we should have been allowed to been on a conference call as the paperwork was signed. I called about that and no return call.

All this could have been avoided had James had been sold the car with only the gap insurance added on as originally requested. The only time we have had any calls from your dealership was when we had the paperwork sent to us FED-EX. Even though we had asked for it to be sent at signing for review Now we got a call on our home phone from Mr. McCall requesting a return call. Please be advised that my husband is a bus driver and it is not easy for him to make phone calls during the day. When he does, he does not want to be sent to voice mail. I work for a hospital and can not easily make out going calls There is also a time zone difference. Calls made have a 3 hour time zone difference. A 10:00 A.M. Call there will be 7:00 A.M. Here. A call at 5:00 P.M. There will be a 2:00 call here.

We are normally very easy people to work with, we purchased a Jetta and a Subaru and had a great experience. Our salesmen listened to us and didnt make us feel stupid.

Our goal is to get the original deal requested, and get the registration.

Since that letter we have contacted the Attorney General of Georgia, BBB of Georgia and filed a complaint with the Federal Trade for violation of the Truth in lending Act. I have been trying to get an attorney in Georgia. If anyone knows one interested let us know, we definately will file a suit.

Recently Bill Heard Georgia sent us an UPDATED packet for an entirely different car! So I left them a very, very polite, but demanding phone call. I told them to pick up their car. So the next day we got about 7 calls asking for our address. HELLO! They have sent 2 FED-EX packages to us at OUR physical address. I just an e-mail telling them we are 3000 miles away and would be happy to drop the car at our local Chevy dealer for them to pick up, BUT we want IN WRITING a statement that this WILL NOT reflect on our credit.

Does anyone know of a class action law suit against Bill Heard in Georgia?

We really want to pursue legal action. Our family attorney locally can't take the case, but has advised this is not a legal completed contract. I want them to pay for what they have done to all of us who have been trashed by them.
