Selling Lemons

I am reporting the following story on behalf of my fiance:

Once upon a time there was a young couple who wanted to buy a newer car than what they were driving. The couple test drove and fell in love with 2000 Jetta V6, black with tinted windows and leather interior. That very night they drove it home. What a good looking and great driving car they thought as they admired it in their driveway.

5 days later they back at CarMax with their Jetta and a bad transmission. Now, I have had repairs made to cars before, but 2 weeks to replace the transmission??? Ok, so after 2 weeks for repairs the couple drives their Jetta back home. The next morning there is 2 INCHES of WATER on the passenger side of car, after a good rainfall it appears that this beautiful car SUCKS.

CarMax Car # 2 a Landrover Freelander. Great car, not much pickup power, bad gas mileage, $100 for an oil change; nonetheless a really solid car. Young man after about a year, decides he wants something bigger and less expensive to maintain.

CarMax Car # 3 a Chevy Trailblazer. Good condition until 6 months later when the transmission is failing, the electrical system is shorting out and other various mechanical problems. Needless to say back to CarMax for the young man to purchase a 4th CarMax car.

CarMax Car # 4 a Kia Sorrento. Good looking car, less some minor cosmetic things such as a seatbelt holder being broken, light cover missing, bumper broken and hanging a little under the car, and bubbly paint. Told the car is in EXCELLENT condition. Young man buys the car.

Takes CarMax 3 times to put gasoline in the car after being sent back 1 time after cleaned without gas, 2nd time with no gas and BLOOD on the center counsel. Also, a few days later a driver's license from maybe a previous owner is found in the side door counsel. Great Job Clean-up Crew! Drives very nice for the first 4 days.

5th day (a Sunday) the four wheel drive light is lit when the 4 wheel drive function is off, the service engine light is on and the transmission is slipping. Young man furious brings the car back Monday the 6th day he's owned it.

After a lot of arguing and screaming CarMax gives the young man a $500 credit towards yet another CarMax vehicle and offers to buyback the Kia Sorrento from the man. After some thought and consideration the decision is made to have a car TRANSFERRED from another CarMax dealership to see if problems can be avoided.

CarMax Car # 5 a BMW X5. Excellent condition inside and out. Young man test drives the car, within 5 minutes of the drive the SERVICE ENGINE light comes on. The CarMax mechanics look it over and say Oh, it was just a diagnosis sensor (or something). We got it taken care of. Great! Young man gets in his BMW starts the car puts it in drive moves two inches... Service engine light comes on. Great job fixing that CarMax mechanics!!!

Needless to say CarMax currently has the BMW and is fixing it. I think they are patching it up. Unfortunately for them I am sick of playing the CarMax shuffle and I had BMW look over the car before CarMax got it back, and if what BMW said is wrong is NOT fixed then CarMax better have their arbitrator on speed dial!

Come to think of it I have never had to sign a legally binding document at a car dealership stating that I would go through arbitration before hiring a lawyer. However, after 5 CarMax cars, 3 of which were lemons, I see why they make us sign that paperwork.
