Ripoff Fraudulent Auto Service Contract

On 4/29/02 an extended service plan was purchased and the salesman stated the contract would add an additional 72,000 miles of coverage to the car which already had 29,279 miles on it. He stated this would cover the car until April or 101,279 miles whichever came first.

We filed all the paperwork in the glove compartment in the envelope that they gave us and then drove the car off the lot and have not had a problem since. On 9/24/06 the car would not start and we checked it out and then called AAA for assistance.

The operator that came out listened when we tried to start the car and said the fuel pump was not working. We had them haul the car to Palm Bay Chevrolet where it was purchased. Left it with the key and information on the policy number for warranty work.

When Palm Bay Chevrolet was contacted the next day, they had started the work and the warranty company called. The warranty company said it wouldn't be covered since the mileage was now over 72,000 miles. When we contacted the warranty company they said you need to look at the inside where it states "Coverage under this Service Contract begins on the "Purchase Date" shown on the front of this Service contract and expires according to the Term or Mileage of the plan selected, whichever occurs first.

Plan expiration is measured in Term/Mileage from (a) the "Purchase Date" and 0 miles if the "Current Odometer Reading" is 5,999 or less, or; (2) January 1 of YOUR vehicle's model year and 0 miles if the "Current Odometer Reading" is 6000 miles or greater."

The plan that was purchased is their "Platinum (PNP)" and was the best they offered. We have never had the need to use the plan until the end of September and when we were told this was expired we complained that they sold us this on the basis of it being an extension of coverage.

Upon a second call to the warranty company we were informed that the dealer had filled in the wrong form since we purchased a "USED" car and not a "NEW" car as the contract stated. Their Contract states "ROYAL PROTECTION PLAN" "MECHANICAL FAILURE SERVICE CONTRACT" "NEW VEHICLE COVERAGE."

The representative said it should have been a "USED VEHICLE COVERAGE" plan so that it would have extended the coverage as the salesman and manager stated. They do sell those contracts and that's what should have been filled out according to "Fidelity Warranty Services, Inc." representative. He stated that we would have to take this up with the dealer since they made the mistake originally. When we contacted Palm Bay Chevrolet on 9/25/06, 'Thomas' was the gentleman that we spoke to and he made it sound like something could be done, but he would have to work on it in the morning since it was late in the day.

He said he'd call on the morning of the 26th, but he never did so we went to the dealer after 4:00pm and he brought out Anne Trelstad who said she would see what could be done. She was gone for a short time and said, "Sorry, but there's nothing we can dofor you." We were not satisfied and told her so. My father told her that this wasn't acceptable and if necessary we would take it to small claims court and we felt we could win based on the 3 witnesses that were present when we purchased the car.

She then insulted us by implying that "Oh, you've done this before?" My father stated, "NO, but I've been a professor of Business Law in Orlando and have taught Business and Ethics since 1990." She gave us her card and said she would call us and then walked away so we left.
