Drive Financial Services of Dallas TX are abusive, malicous, and tortulous. They have called every reference that I had to give to them and told them that I was going to jail, they were going to reposses my car and that I do not pay my bills. Talk about abuse.

These references did not have anything to do with my contract with Drive. They have overstepped their boundary by discussing the nature of our business transaction as prescribed by law (FDTPA). They called my job day after day even when I faxed them a letter and told them to cease and desist the communication, especially my job.

I work with children and can not leave my room. They just kept calling my job, and I told them that I could lose my job. They did not care. Disclosing my personal business of to my references and my job is totally against the law.

Did they embarass me? Hell yes they did. Did they make me feel less than a human? Hell yes. Did I suffer? I am taking medication for depression and anxiety due to their relentless harassing, annoying, and deceptive practices.

On June 9th, I purchased a cashier's check from my bank to catch up on my note. I was not behind. Drive cashed the check on June 21st two days later they repossed my car. I was caught up. They had no right to take my car. I called and complained and the man, Frank started laughing at me, telling me that I will not get the car back and that they were going to sell it and there was not a damn thing I could do about it. Frank was abusive, he harassed me, even after I hung up my phone, he did not. He was just taunting me. He said that I did not have enough money to pay my note and he knew that I did not have any money to get my car back.

He stated that I better have me a good damn pair of walking shoes. I told him that he better not call my phone back because now he is committing a criminal offense by harassing me and holding my phone. I hung up but he did not. I screamed at him and told him to hang up my phone. I hung up the phone and waited a few minutes but he called me back from a private line. I cursed at him and hung up the phone.

He called back again from an unknown number. I told him that I was going to call the police because now this is harassment and he is being malicious about it. As of this date, September 2, they have not sent me any notification on how to get my car back.

In my contract Section 2 (f) it states:
How you can get the vehicle back if we take it. If we repossess the vehicle, you may pay to get it back (redeem). We will tell you how much to pay to redeem. Your right to redeem ends when we sell the vehicle.
(g) We will sell the vehicle if you do not get it back. If you do not redeem, we may sell the vehicle. We will send you a written notice of salle before selling the vehicles.

I have not received a letter to redeem but I did file a complaint with the Office of the Consumer Credit Commissioner who sent Drive Financial a letter requesting records. This was sent to them in August. Drive have not sent anything to them. They cannot because they have neglected to send me a letter of redemption. I paid them $ and that brought my account up to date.

I received a letter dated 7/24, which stated that my balance was $340.47. My note is $299.00. I was not in default at the time of repossession. I filed a police report on the harassing phone calls. I filed a complaint with the Office of the Attorney General, I filed a complaint with Texas Department of Transportation.

The reason I filed the TXDOT complaint is because I had to pay $81.00 to get my belongings out of the car. This was very unethical. When TXDOT investigated the tow company, A-ASAP Quick Towing out of Arlington TX, they were in inactive status.

This meant that the towing company had no license to operate when they towed me and their license was revoked due to my complaint. Drive Financial knew of this and should be sanctioned with penalties also for allowing and employing this tow truck company to repossess my car.

I am not going to stop. I am very depressed over this whole ordeal and feel that Drive Financial Services is an unscrupulous business. I care that others do not become victims to this loanshark. We are poor and we are being preyed upon. The AG's office have 83 complaints active against Drive Financial today. The Better Business Bureau have 277 complaints.

I am asking the AG office to investigate these complaints to see what the pattern is. They are abusive people and they try to use their big time attorney to scare people. I know that there is a class action lawsuit against them with Attorney Tomlinson out of Houston Texas, and a couple other states are suing Drive Financial due to the fact that they maliciously and knowningly sent out demand letters to customers disguising themselves as an attorney office when the letters generated were in fact from Drive Financial itself. How deceptive is that?

Anytime a company is serving the public and is being deceptive like that, who is protecting the consumer. I do not feel that a slap on the wrist is sufficient. This is criminal guys. Just like they lied and told my references that I am going to jail, class action lawsuits hold these guys accountable to their failing to abide by the law.

As for the tow truck company, they are still operating even though their license is revoked. How can they get away with this? They need to be stopped. If private citizens do not know how to stop them, we are asking for the AG's Office, TXDOT, OCCC, the BBB and any other governmental agency to shut these guys down. They do not need to victimize the victims any longer. Poor people do not want to be poor but they should not be victimized because they are poor.

If every one was rich then there would not be a need for the loan sharks. STOP DRIVE FINANCIAL! They are not helping the poor and unfortunate people down on their luck, they are keeping them down.
