As of this date, this issue has still not been resolved. A few more parts have been received, but the balance of the parts have not been received, including the most important, the motor.

A promise date for receipt of the motor and primary drive was July 21. The primary drive is now promised for July 28 with no date for the motor.

Exotix Cycle & Motor Werx Inc. Was paid IN FULL on February 16 for the parts to build a COMPLETE motorcycle. Exotix received a check in the amount of $23,000 and a motorcycle with the agreed value of $8500 for a total payment in full of $31,500. No payments, 60 or any other amount are owed to Exotix, as stated in Ms. Barontini's letter.

When the frame for the motorcycle was ordered, it was stated to Mr. Barontini that we would NOT like him to order parts a few at a time. All of the parts were to be ordered at one time in order to complete the motorcycle. As to Ms. Barontini's claim that the parts are for a custom motorcycle, the motorcycle is custom because it is being built by Dennis using purchased parts. As to the claim that the parts are taking longer due to being custom, this is also false.

I have spoken with the representatives from RC Components, makers of the wheels. There was a seven week delivery promise of parts from time of order. A usual wait time is six weeks, however, the chrome tanks HAD BEEN temporarily out of service, but as of March 4, the chrome tanks were completely functional and only caused one additional week delay. Thus, if the wheels had been ordered the week of February 16, they would have been received by April 7. The wheels were received the week of July 21. A motor from Total Performance can be delivered within two weeks of payment.

Dennis spoke with Mr. Barontini and discussed a change to the motor the week of March 17 (also discussing no additional charge due to a lesser priced transmission). This would mean the motor should have been received no later than April 7, conservatively. As of this date, the motor has not been received.

It is true that Mr. Barontini offered to return the motorcycle given as trade. He offered no other monetary compensation. Since the agreed value at time of trade was $8500, and the motorcycle had been used for additional mileage, this hardly makes up for the additional $16,700 worth of parts that had not been received.

It is also true that Mr. Barontini offered the use of mock up parts. This is because the ordered parts had not been received. It was not asked, it was offered. The Exotix shop was also offered as a place to complete the work. The offer was declined.

As of this date, July 27, this issue has not been resolved. This issue will not be resolved until all of the parts have been received. Again, Exotix Cycle $ Motor Werx has been paid in full. There are no payments due to them, or to any other parts provider, from us. They have been paid $23,000 cash (check) and $8500 (motorcycle trade in value) for a total of $31,500 in full.
