Gives No Leway for Hurricane Victims Ripoff

First off, I'm a displaced Hurricane Katrina Victim from St. Bernard Parish, LA now living in WY. Secondly, I went through a divorce earlier this year where my ex-wife stopped paying my bills a month or so before she served me surprise divorce papers.

Americredit called for their money right after the papers were served and I set up a deferment with them which cost me $345.00. I never signed any paperwork, only a verbal agreement with the rep over the phone. The first post deferment payment was due on September 3. Oops, didn't expect a devastating hurricane to mess up my payment plans.

After Katrina I repeatedly tried to call Americredit in the days after the hurricane with no luck. Always a busy signal. I was finally able to email them which they answered with some automated reply message. After about 6 weeks (around Oct. 10) I was able to contact a customer service represenitive who kept trying to get me to say that the vehicle was totaled in the storm. When I explained that wasn't the case, the supervisor whom I had asked to talk to, became very belligerent and told me that they didn't care about the hurricane it wasn't their problem, that they wanted their money and they wanted it now.

Nobody tried to contact me after that. I made a payment of more than half the over due amount on 11/1/05. The next day a customer service rep Molly' called me and said nothing about the payment she only said that they were trying to locate the vehicle in St. Bernard Parish and were unable to do so. I once again explained that the vehicle wasn't totaled.

Again they were angered and said that they had it listed as so and they are filing an insurance claim on it, and they want me to sign a voluntary repossession on the vehicle! I said no way! I am making payments on the vehicle and keeping it and that's that. They also wanted to know exactly where the vehicle is at (I'm sure because they want to come repo it even though we are making payments and are only 30 days past due!) Americredit has been horrible and rude shysters with the post hurricane business it is conducting and apparently all their other business dealings.
