Ripoff, breach of contract, negative affect on credit report, misleading and deceptive sales

On October 16 I purchased a 2005 Toyota Solara from your dealership. As part of the deal, I traded in a 1998 Ford Taurus (which had a balance owed to the financing bank of $8000). It was communicated to me by Donnell Middleton that I would be able to trade in the Taurus and that New Rochelle Toyota would pay it off (or bury it in rebates).

As of November 17 (1 month later) the obligation has not been fulfilled. I have been contacted by Condor Capital (the bank for the 1998 Ford Taurus) numerous times and told that I am still liable for the car note. I told them that I traded the car in and that they should be receiving a check shortly, however I was told that I am still responsible.in addition, since one payment is over 30 days late, it has been reported to the credit bureaus and has impacted my credit negatively. I have called Donnell several times and left messages. He has not returned any of my calls. Condor Capital called him and he has not retuned their calls.

As I reflect on the conversation between myself and the special finance director, Donnell Middleton, I am deeply bothered. Donnell said to me that the bank had only approved a certain amount to loan me. That amount was only enough to cover the new vehicle (2005 Toyota). The bank was unwilling to lend additional money to cover the amount I owed on the 1998 Ford Taurus (approximately $8,000). Donnell said to me that he had come up with a solution. He said that he comes across a lot of customers each day. What he would do was to add on a little of what was owed on the Taurus to each customers total until it was paid off. At this point, I had already given $1000 cash down payment, transferred my plates and insurance over to the new car and handed over the keys to the Taurus. I was stuck. I knew what Donnell was doing was wrong, but at that point I had no choice. I had signed all the paperwork, had the keys to the new car in my hand and was ready to walk out of the dealership when Donnell told me this. As a matter of fact, they had driven the new car up to the dealership door. Donnell waited until the last minute until I had signed everything before telling me of how he planned to pay off my trade. It seemed to me that he planned it out pretty well.
