I ate at Wendy's in Largo, FL one day and before I could finish my meal I had a tooth break off. I went to the dentist for an evaluation as to the cost of having it repaired and submited that report to Wendy's Inc. I asked to be reimbursed for the nearly $5000 it would cost for the repair. Their lawyer told me that because I had had dental work and the tooth was not perfect to begin with I had no claim!
I had to pay for the repair myself and cannot eat at Wendy's any longer because as they said, "my teeth were not perfect". I had just been to my dentist the week before for cleaning and a check up and he reported no problem with my teeth. That is documented.
Yes, I was 60 yrs old but have had good dental care all my life and if that is not worth acknowledging then i have no case as Wendy's says.
I find it illogical to believe that only people with perfect teeth can eat at Wendy's or be at risk. Wendy's is guilty of fraudulent and misleading advertising as I never saw a disclaimer in any of their commercials. They do show in their ads people of all ages eating at Wendy's. It is common knowledge that few people have perfect teeth.
If eating at Wendy's is a risk then the public should be notified of such and Wendy's should advertise a disclaimer when promoting itself.
