Threatening to Foreclose - Refuse to Modify Loan - Refusing Payments - Overcharged

Our mortgage has been serviced by four different companies in about six years. I've never had the first problem until Bank of America. About 18 months ago they began threatening me with foreclosure and said I was behind on my escrow.

The original payments were in excess of $500. They got up to $966.77, including escrow (which has always been included in payments), $39.34 FHA MIP, $116.01 late charges and $15.00 fees due. They finally admitted two months ago, with help from my insurance company, that my payments should be $836.64!! Wow! I continued to send the $966.77 in hopes they would apply difference to amount they claimed I was late but they refused it and mailed me a check for the difference.

I have tried the 800#, only one I have, numerous times attempting to get assistance - all in vain. I wrote two letters asking for a loan modification and received two from them telling me the paper work was being handled to modify the loan. I've not received anything to that affect and almost every day I get letters threatening foreclosure because I'm in default. That amount has risen to $1,924.65 from $800. Due to the addition of late charges and fees every month.

My husband is disabled and has been bedridden for years. I'm worn out fighting with BofA! The interest rate has remained at 6.5%, my escrow has decreased yet my payments have nearly doubled. I owe about $70,000. Less than the last appraised value. I'm being RIPPED OFF!
