December 15 we met with a sales rep who promised us we could increase our sales because we could offer our customers 90 day financing. The sales rep made it sound as if we could allow our customers to have the opportunity to get our product and pay later but all the while giving us the funds we needed up front. He didn't tell us we had to get post dated checks from them and that it would actually take 90 days for us to receive full payment.
When the sales person met with us he brought a brochure with him. He had removed the company's logos from each of the pages. Upon questioning him he later told us it was with EPS (Electronic Payment Systems). He never mentioned Lease Finance Group. He told us it was $99 a month period and even gave us a one hundred dollar bill for the first month. (Later the charges coming out of our bank account were $165 / month). He told us he would get us copies of our contract as soon as possible. We never received copies of our papers until January 8 which I requested when International Card Est. Called me. Apparently in our contract we had 10 days to review our terms and modify, but because we were never given copies of our contract, we of course were not able to cancel or modify in a timely matter. The contract was supposed to be under both mine and my husbands name and parts of the contract were missing both signatures and initials.
The contract asked for a store front property. We have a home office but our sale's rep said not to worry about it.
Another thing... We told our sales rep we didn't need credit card equipment because we did everything through Quickbooks. He said okay. And then a package with credit card equipment appeared at our doorstep. He said it was needed to process the 90 day financing and run the checks from our customers. He came to our house and set it up.
We reviewed our paperwork and found out that there were more companies then just EPS we were now working with. We were now involved with International Lease Center, EPS and Lease Finance Group.
We closed our bank account and returned the equipment with a letter stating what I have stated above telling them that they need to cancel our contract immediately. We have never processed anything with their equipment. We also included a letter with our attorney's name and number.
We are continuing to get call after call. The agent is telling us that if we pay him nobody else will see our bank account information and that it will show as a good faith payment and we will be able to come to a settlement. We have told them we are not giving them any more money especially without seeing a settlement offer first, we do not agree with their terms because we were mislead and are victims of fraud. The agent said we are not victims. We told him to contact our attorney. He said, "you have a head on your shoulders and can make decisions for yourself. Your attorney will only relay what I am telling you right now." He was very rude and disrespectful. They are calling our cell phones and will not quit. Now they are saying they are going to sue us.
