This report is to inform everyone of the injustices we feel have been done to us concerning our mortgage with Wells Fargo. Let us start by saying, we are a hard working family trying to do the right thing and as many other Americans may feel can never get ahead. We are not sure where to turn or what to do about this matter with Wells Fargo, but something needs to be done.

It all started in when Cheryl got sick and was out of work for an entire year, I lost my job in April of that same year. We tried our best to keep things going, but finally got to a point where we just could not keep it together anymore.

Wells Fargo was not willing to work with us, except to take the back payments and divide them by 6 months ans have us pay our payment plus this outragous amount of almost $1681 a month. This is $600 more then our normal payment of $1080 how is anyone going to be able to do that when they are about a year behind on every bill they owe. They can not. It was almost like they were forcing us to just walk away from the house so they could foreclose and get the insurance money since we have a FHA mortgage.

We could have walked away and filed Chapter 7 Bankruptcy, but we work hard and want to pay our bills on time and in full. That is why we filied a Chapter 13 Bankruptcy, so that we would still have to pay everyone back we owe and save our house, so we thought. We also asked them if we could just do a streamline refinance and they refused and said that is a privilege to refinance.

Well, I would think it would be better to refinance someone and lower their monthly payment then to get an attorney involved and pay him, then wait a year with getting no payments and then sell the house for a lot less then what is owed to you in the first place. IT IS JUST NOT RIGHT...

If that was the only problem we had with Wells Fargo that would be enough, but unfortunately that is not the only problem. The list is as follows:

1. Wells Fargo paid taxes to someone else's tax ID number for 2 years and the sheriff came out and posted a summons on our door that we were going to lose our house if the taxes were not paid. We had to do all the legwork to get this problem solved. They fought us on the facts that we showed them the number was wrong. We were told that if it was their fault they would pay all the late fees to the county, come to find out they took the late fees out of our escrow account - which made it have a negative balance. Keep in mind this legwork was performed at a loss of 3 days unpaid to take off work to correct the situation.

2. Wells Fargo has only paid the Town of Magnolia taxes for 1 year and we have lived here for 4 years. This caused the Mayor to come knock on our door and question us on why we have not paid our bill on at least 4 different occasions. We try to tell him that we have talked to Wells Fargo and it should have been taken care of by now. It has not, and Wells Fargo refuses to talk to us because they say they cannot due to the fact that we are in Bankruptcy. Current taxes for 2004 have not been paid.

3. Our payment has been changed so many times; we are not sure what the correct payment should be. When we first got the loan in July it was a 2/1 Buydown, which means our payment would only change 2 more times and then stay fixed unless escrows changed. Wells Fargo still doesn't have to escrow amounts correct.

4. When it comes to our payment, some documents show our payment as being $1080, and others show $1101 and then again another document shows $1090. When computing late fees, Wells Fargo uses all three figures. This is not consistent and adds to our confusion.

5.in late September Cheryl's mother passed away. During this time we were all beside ourselves, trying to keep things together. We always hang on the refrigerator an envelope addressed and stamped to Wells Fargo and put the weekly money orders in the envelope so that at the end of the month we seal it up and send out the payment.in the confusion, Orville's mother mailed the envelope off and there was only one money order in there for $300. Since we filed bankruptcy in Wells Fargo no longer sends monthly statements, so we were unaware that we made a mistake.

When we thought that we might have made a mistake we called Wells Fargo and they said they could not give us any info about our account, but if we were late our attorney would notify us. After not hearing anything from our attorney for over 30 days we had to assume our payment was not late and on time. We accessed our account info online, but that info is always wrong so we were unable to tell. We did not hear from our attorney until March five months later. Wells Fargo had filed a motion with the courts to be relieved from the automatic stay due to non-payment of a post petition payments. We paid the past due amount immediately, which also included attorney fees, court costs and we had to pay our attorney to take care of this matter.

This could have been avoided if we were notified in November that we did not send all of October's payment.in addition Wells Fargo is still charging us monthly late fees, they are posting our payments in a suspense account then posting it after the due date and then charging us late fees, they say that our next payment due is for December It should be Spetember 2004. They are not abiding by the rules of the Bankruptcy Court.

They have got to be stopped of this maddness. We are sending letters, emails to our Senators, HUD, Banking Commission, Attorney Generals Office, NAACP, 60 Mintues, 20/20, Montel Show, Oparh Show, local newspapers, local news stations.
