Cross Country Bank and Midland Credit Management, Inc. Rip-off! Dishonest, fraudulent collection

A few years ago, I recieved a letter in the mail offering me a credit card. My credit was really bad and I was unable to get a credit card. I called the number on the back of the credit card sent to me and to my amazement I was given $300.00 line of credit. I had the card for about two months before I tried to use it to pay for a $6.00 meal at a restaurant. The card was declined. After many phone calls, I learned that the card had been used to pay the fees for itself. The fees were $350.00. I told them to cancel the card and I was not going to pay fees on a card that I did not get to use. To me, I was basicly paying $350.00 for a piece of plastic.

Shortly after this, I got a copy of my credit report in order to pay off my past debt and try to fix my credit. Cross Country Bank was on there and the total amount due to them was $1122.80. I was outraged. My wife began sending out checks to pay for my past debts.in the process, she did a check by phone to Cross Coutry Bank. I didn't want to pay them, but atleast the whole thing was over with.

Two months ago, I began recieving phone calls from Midland Credit Management, inc. They were contacting me to collect the $1122.80 owed to Cross Country Bank. I told them that I already paid the amount to Cross Country Bank. They became very angry and told me that they would sue me if I did not pay.

Yesterday, I recieved a certified letter from the Licking County Municipal Court. I am being sued for the amount. Since, I paid the amount using a check by phone, I don't have a reciept. Also, since it was paid a couple of years ago, my bank history show history for up to 1 year. I have no proof of paying.

I did research on these two companies and found out there are multiple reports of fraud on each. Cross Country Bank has also been sued by 3 different states. My main concern, however, is that I have 28 days from yesterday (8-12-04) to respond or I automatically lose the judgement. Without proof of payment, I do not know how to respond. All I know is I am being scammed and do not want to pay this again.
