I had my ATM card stolen and did not realize it until my bank statement came in. I was shocked to discover that over $1,000.00 had been withdrawn from my checking accountwithout aurthorization.
I stupidly told the bank that I suspected a family member of mine was the one who stole my ATM card. The person in charge of my case told me later that "since it was a family member, and the family member may have known my password, that the bank was not liable for the money stolen."
I filed a police report and went to the bank and talked to the representative again. This time I told them that I did not know for sure who stole the card and that the police were looking into it, but unfortunately, the police could not retrieve any of the ATM camera tapes because all the tapes where the ATM's had been used at had already been taped over again.
So I went back to the bank and told the representative that I truely had no idea who had used the ATM card and could not prove that it was or was not the family member I had suspected.in fact, it could have been anyone, all they had to do is watch me make a transaction and put in my password. Like at a store, where you slide your card, then put in your 4 digit password. All I would have had to do is accidently leave it on the counter at the store, and if the person at the register had seen what my code was when I typed it into their machine, they could surely have kept my ATM card and used it themselves. Now the bank was telling me that they still weren't responsible because "someone would have had to know my password to have used the card" I say BS... I just explained how someone could have gotten my password.
All the representative of First Bank told me is "Well there is nothing I can do." So I lost all my money. And couldn't pay my house payment or electric bill for one month, and do you think the bank cares? No, all they cared to do is charge me fees for overdrafts that the stolen ATM's caused me. That didn't help me catch up the following month... So I suggest if you are in the Wichita Falls or Burkburnett Texas area, don't do business with First Bank, and if you do, don't take a ATM card because they aren't going to stand behind national banking policy and replace any money stolen from a lost ATM card. They will just make up excuses.
After all, why does any bank advertize that they will replace any money stolen from ATM theft if they can stand behind these sorry excuses and deny your claim? Just another case of the Banks and other huge corporations getting rich off the poor person.
